Some people have been receiving calls that this was a misprice and on JD's fault that the item was confused with some ladies clothing (hence the sizes were ladies dress sizes, which I failed to notice).

However, as with most misprices, I have had a look at the T&Cs and they are very loose, they suggest that the contract has been formed once a confirmation email has been received.

1.3

JD Sports' acceptance of the Order shall be by email confirming the Goods ordered, the price of the Goods, the arrangements for payment, the arrangements for delivery and the packaging and postage charge. The acceptance will be deemed complete and will be deemed for all purposes to have been sent to the Buyer at the time JD Sports send the email to the Buyer

As the price was listed as an 'invitation to treat', and you (the consumer) has offered to buy at the price of £15.99, they are actually legally obliged to send you this item at this price if they send you an acceptance email. Of course, if they literally have no stock in the size you ordered, you may be out of luck, but JD may respond with a gift or alternative resolution to avoid corporate hassle.

Sorry if "this tread was gay" ;)

EDIT: Johnny or any other legal people feel free to verify, this is very basic contract law :)

same as the littlewoods one? here atleast they give you a full refund if you wish not to persue it further, rather than try and rip you off £25 ;)

Plenty of people on HUKD are writing to head office and alerting watchdog, enough complaints should see some justice if you're lucky enough - I'd send a recorded letter;

Littlewoods Head Office,
1st Floor Skyways House
Speke Road
Speke
Liverpool
L70 1AB

Other people are having the same issues here (http://www.hotukdeals.com/forums/showthread.php?t=84389&page=26).

Edit:

Ordering Goods

2.2 ... Your order will be accepted by us (and a contract will then be formed between us) when we despatch the goods to you. Title to the goods will pass to you on delivery.

2.3 Where you have redeemed a promotional code or any other offer ("a Code") against your order, acceptance of this order is subject to our verifying that the Code has been issued to you personally, that you comply with all the terms of the offer and qualify for the Code. In the event that the Code has not been issued to you for your personal use or you do not qualify for the offer, the price of the order will be adjusted notwithstanding any email or other confirmation that you receive.

If you can reason that the code was for personal use obtained by you, a contract should have been formed. However, big companies like littlewoods often have very fined wording towards this, and may be able to find themselves a way out. As said before, I'd seek help from people in the similar situation and alert business authorities, such as BBC's watchdog. Hope some of this helps :)

That line pretty much sums up that we have to pay.....haha forget it...cant be arsed...will just send them a cheque and get them to close my account

mrolinc
4th October 2007, 12:13
sure, but what is to say you don't qualify for the reduction? huge companies like littlewoods never issue a code to say one or a few users, they are property of the public once they are printed.
