charged me £90 on thursday for being od 3 months ago, here's the best bit:
i was overdrawn on the 28th august (day before my 18th) and the account didn't go back into credit till the 3rd of september when i had turned 18, so because i turned 18 during the od period they think they can charge me for it!
the big issue though: i used £14 (in store) (of 14.75 in my account) around the same time as the charge from the bank, but the bank charge went out first, taking me £80 od, but as of today my account will be £94 od, and they are going to charge me £15 a day till i get it back into credit (pay day on friday) totalling a £200 charge!
intent on making their lifes hell from now on because:
the £90 is a price they set whilst colluded with other banks to charge such a high rate (totally illegal)
if you're a llyods tsb customer could you tell me if you have been informed of the 'new' bank charge of £15 a day! they aint getting it if they haven't informed me!
well they aren't getting any of my money, cancelled the account and arranged for my pay slip to come in cheque version, next step, switch banks!

banks just take the piss because they can simple and now you cant claim cus the banks are in court saying that they can charge what they want.
of course you can threaten the bank with court tyhey used to just say here have it back but now they go court with you
youve gotta ask yourself is it worth the risk

Go and speak to them about it rather than sitting on here...

And that comes into play on the 1st November iirc.

Hi Josh,
Sorry to hear about the monetary misfortunes. The bank will have first call on any funds in your account to pay any charges, you will need to read their terms and conditions which are usually contained on the inserts within your statements.
My advice is to ask to speak with the manager and request for the charges to be removed - most banks want to keep their customers and will try to help. Set up a "parachute account" with another bank, have the details to hand when you see the bank manager. If he refuses to rescind the charges, ask politely for a figure to settle and close the account, hand over all the outstanding cheque books, debit cards etc and then transfer everything (wages, direct debits loan payments) into the new account.
Only do this when you have the new account set up. Also if you are paid by BACS, then ensure that your employer is aware of your new account details.

iirc? whats that stand for? it's the 5th now btw, and i know they said they charge what they want, but not when they've all agreed to charge the sime extortionate amount, and they can't charge the new charge if they haven't sent a letter to every customer and received a confirmation from the customer, it's a very serious change to make without informing anyone
not much i can do, i've been on the phone to them and told them if they keep charging they're aren't getting the money in the end as i don't earn enough, i was quite happy to pay the £90 even though it's an illegal charge, but no way am i going to put up with oweing 200 by the end of the week :N:

Just cos you turned 18 has nothing to do with why they have charged you. My bank charged me for being overdrawn on my account when I didn't even have an overdraft facility. If you don't have this facility then they are well within their rights to charge you

You WILL have had something in writing from them, weather it be in the form of a letter or a new leaflet of their terms and conditions of banking.
Unfortunately there is not much you can do about it other than ask them to "freeze" the charges as they are in dispute. This might give you a small window to get your finances in order.
My advice: control your finances better

a 17 year old cannot be charged by their bank. period. they also cannot gain a credit record.
i went £3 over hardly bad finance issues really, bought slighty too much petrol but knew i was getting paid within 3 weeks and wouldn't get charged as i was 17
i know they can charge me for being od, no doubt about that, but not when i was 17, and i nor any other tsb member i know of has been informed of the change in their charging ways. i also didn't receive a letter telling me the date or even the month that i would be charged for it, which i should of.....

as other people have said take better control of your finances and set up and overdraft of say £100 so if you do go over at any point you wont get charged stupid amounts of money

Your family doesn't receive much post, does it? Did your sister not have problems with "not receiving letters from the car insurance company"?

haha you'd think so wouldn't you, maybe a striking postman threw all our post away?? we may never know.......
anyway its sorted now, i will still be charged that £90 but they've dropped the £15 a day charge as in their own words:
"after no information on our charging procedures were received by you, and upon printing a receipt from a cash machine you have proof that it stated you were £14 in credit, so these charges sahll be dropped"
well thank fook for that :-D

I beg to differ cos I was charged at 17. Its in the terms and conditions when you open your account I'm sure of it.
Perhaps you should take a look at your account paperwork before going off on one at people for giving their opinion cos it isn't just me you've been irate with ;)

I don't remember that far back to say weather I was charged at 17 or not but I suppose it would depend on your account. If you have a current account with a visa debit card/switch and a cheque book I reckon they can charge. Unsure how old you have to be to have a current account though
josh1989
5th November 2007, 12:57
nope i've read the terms and conditions and know the law, a 17 year old cannot be charged, you should claim it back, i reckon they've changed their terms and decided to charge me for it...we may never know.....

Even with a Visa Electron account they can charge you if you go overdrawn. It's a bank they aren't gunna lend you money for nothing are they ;). They also don't bother bouncing payments cos it costs them admin fees that they will only charge you. It's a vicious circle tbh
For a current account I think its 18 or 19. I forget cos I didn't change mine til I was 19 anyway

Put yourself in your bank managers shoes. Your customer goes overdrawn are you going to let him off with no charge? I think not cos banks do not lend you money for nothing :p

i'd charge them, but then i'd just want the money, they've just been charged 20% of their profits for illegal collusion, so why would they break the law again by charging 17 year olds, i hate to say it again, but you cannot be charged for going od if you are under the age of 18!!!!!!!!!!!

I'm intrigued about this law that you can't charge a 17 year old. Can you link me to your source of information? Just wondering since I was charged

They can charge you because you have insufficient funds. Therefore you are borrowing money which you shouldn't be, just like everyone has said so far!
Get over it!

i take economics and are taught about this stuff, you could google it, don't know what you might turn up, but basically, from the age of 16 you are allowed a visa debit card, that can be used at cash machines and in-store, say you had £17 on the account, and went and spent £20 in store this would take you £3 o.d, because the store didn't know the account didn't have enough money in it, so the bank lends £3 to you, if you were over 18 and had no signed o.d limit, you would be charged around £30 (before the banks raised all their prices!), but if you have a visa debit and this happens when you are under 18, you are not deemed and adult and so not liable for spending too much, and so will not be charged, and will not have it go against your credit rating.
i think the only thing they would do if you were od and not 18 is shut your account and make you pay it back, it would have to be an extreme amoun though
