Right here's the thing...

Sold a product (of mine, nothing business) to someone on this forum....

I described the product, said what was included, took pictures, he asked price and i said offers, he made a offer, i accepted and even said i would inc p and p for free.

Fine

He sent the cheque that cleared into my account on 30th December. He said he didn't mind when they came as long as he got them before FEB.

It's now 19th JAN. His Brother rings me and gives it his all. He say's not happy not how it was described. Etc. I DID forget to include one part ( my mistake and i said sorry i will get it sent down 1st class today so he has it tomor ) he say's no not happy etc shouts abit. Give me his address say's he wants a cheque. If he dosn't get it in a week he will be down to take me to the cash machine.

I know my rights and he can't take me to the cash machine and he has no reciept etc they were sold as descrobed etc with pictures.

Where do i stand. I just rang my dad ( who is a barrister ) And he said i need to talk to the kiddy not his brother so i have sent him a pm outlining whats going on etc.

Where do i stand though? I don't have to give a deposit do i? And if his borther come's down to try and make me i can refuse right?

What do you think!

i'm no lawyer, but i think you should try to work it out with the kid, not his brother or whoever...

i certainly don't think it's ok from him to send his brother to talk to you...

if he is such a kid and cant handle money, they simply shouldnt give it to him...

he asked about it, you sent him the full description and pictures, he said ok, you accidently didnt send him 1 part, said sorry and sent it, and i think that's it...

the brother should be angry at the kid, not you...

dont give him any money

so he;s complaining because he hasn't got his product but he sed he doesn't mind when he gets them, just before feb! but it isn't feb yet so your ok! you have followed what he's sed and he's trying to change whats bin sed!

right as such he cannot demand a refund, you sold the good s as described, adn ok you forgot a part and have offered to send that at no extra charge, thats fine.

As a good will gesture you could refund him the money but as i see it it would be up to him to send the goods back in exactly the order you sent them to him i.e. no damage. And if he turns up at your door saying hes taking you to a cash machine simply call the police or hit him with a hammer.

I dont understand why you mention giving a deposit?

If you described the item correctly and honestly forgot to include a piece of it (?) then I think you are being fair in apologising and sending the missing piece ASAP.

However, now that the item has been received, the buyer may not like it? This happens, but if you described it fully then that is unfortunately the buyers problem in my eyes.

However, I always try to be super fair and would probably take the item back if it was returned in correct condition... and provide a refund.

At the end of the day, nobody can/should forcably make you give a refund.

I agree you need to speak to the original buyer and sort this out properly, rather than it result in a bitch fight.

Can't understand why the lad's brother is doing all of the argueing. If the lad is unhappy with whatever it was you sold him for whatever reason surely he should contact you directly and explain why he's unhappy. The brother demanding a cheque sounds a bit suss tbh.

its up to you, but only give a refund once you have the product back and checked that its in the same order you gave it to him in

make sure it works to, any damage explain to him that as its been damanged you can not refund it.

tell him if he bought somthing from a shop and didnt like it and then damanged it slighty, they would not offer a refund..

you perfectly explained what he was buying, so its his problem that his brother doesnt agree with his opinion...

maybe he/they think you asked too much, and they're angry...

caveat emptor, may the buyer beware. look it up, its the law on second hand goods.
