Anyway, my cousin has just recently failed her 3rd test.

Her account is

She came on the roundabout and a car pulled out, so she went to crawling pace (as your not aloowed to stop on roundabouts), she wasnt close enough to hit the car in front but the tester person slammed on the brake only with the dual control which stalled the car and another car went into the back of them.
surely this tester was in the wrong.

Where does she stand if this is the case, as tbh, she can be a lying cow sometimes.... so there is probably more to it.

at the end of the day does it really matter, as the person taking the test will not be beleived over the tester

examiner will just say he dual braked to prevent accident

If the tester dual braked, then the car should not of stalled.

The tester has a CLUTCH and a brake pedal...

to be honest, the car went into the back of them

if you go into the back of someone, its your fault

Your sister has a strong case tbh as said above..

No matter what, if someone goes in the back of you then its their fault. They should have been using a safe stopping distance. Especially if the car infront had L badges on (which it would of done or they wouldnt of let her take the test in the car).

If the examiner says he braked to stop an accident, and the car stalled, he should of put his clutch down aswell (which he must not of done).

However on the bad side,

The examiner was in a situation where he had to use the brake (in his own opinion). Therefore it would of been down as a Dangerous, so your sister failed.

The examiner normally gets away with it, it would be much easier and quicker just to book the exam again and hope for the best tbh.

(I expect theres more to it tbh, like your sister pulled out at wrong time/went to fast around the round about/lost control of the car etc).

Is there any witnesses?

just hope she dosent get the same examiner next time :p but also i dnt think the examiner would press the brake for no reasoin
