A mate of mine has just bought theier 1st car, they spent £800 on it from a dealer (independant). Now they said at the point of sale that the few defects would be put right, mainly a blowing exhaust and a new door mirror and a replacement arial.

When the car was delivered they had not done the things they had promised and also they had 'attempted' to re-spray the rear door which has over-spray up the black trim on the B pillar and the colour is a mile out! The glovebox door fell off after they guy had left and their is no owners manual or service history book, I also noticed the bonnet does not sit right as it is mis aligned at the front also the starter motor sounds as though its on its last legs.

I told them to take it back and demand their money back as they only took ownership on Mon 7th April.
Anyone got opinions of where they stand with this from a legal perspective? :fcuk:

He should have signed something to take over the ownership and some legal mumbo jumbo, therefore he shouldn't have any problems returning it.

Although, did he get the things they were gonna do, on paper? i.e to confirm what they were gonna do?

There is a law statin that all cars selt by a dealer must make it from the dealership to back home legaly, dont no if you could maybe work this in your favour, especially if it has a blowen exaust, as this it classed as an MOT faliure, thus being illegal..... worth a try IMO

No, there isn't.

By what the original poster say, the car has been mis-sold and contravenes the Trade Descriptions Act (1968). If your friend has a document that states "sale subject to x,y and z put right" then, arguably, he is entitled to reject the car. The issue lies with the fact that the car was £800 - without the car being mis-sold, you have little legal recourse; i.e. a dealer could argue that the car has not been falsely described.
