PLEASE READ :( ..
ok, so someone crashed into me a while back la ddee da de da- to cut a long story short the third parties insurance has just sent me a letter saying this..
'we note your vehicle is probably damaged beyond economical repair. it is in the intrests of all our customers to ensure that any storage charges incurred are kept to the minimum. the company will normally pay reasonable charges where incurred with its consent. to ensure the vehicle is properly protected and to avoid or reduce any charges we propose to move the vehicle to safe storage within 72 hours or our engineers inspection (THAT DID THAT 3 DAYS AGO!!)
we have instucted our salvage agents to collect your vehicle and love it to a place for free and safe storage. please contact us immediatly on 0845 ********* if this is a problem.
please send v5 and MOT etc etc to our address..'
WHAT DOES THIS MEAN? DOES IT MEAN THEY ARE TAKING MY CAR TO BE CRUSHED?? I WANT TO RETAIN THE SALVAGE!! I WAS DRIVING THE BLOODY CAR TODAY ITS ONLY GOT A LITTLE DENT!!
WRITE BACK PLEASE
it needs to be taken away to be assesed so they can work out how much to offer you. Thats what i think it is.

IM DRIVING IT TO MY MUMS TILL MONDAY SO THEY DOTN SNEAK IT AWAY WITHOUT MY CONSENT. sorry caps off.. ermm ok well i need to confoirm that before they take it, im retaining the salvage whatever, even of court action will be needed
They can't steal it mate. Give them a call and discuss a time and a date when they can come and get it. Maybe offer to drive it to the assesor.
Thinking about it, is it possible that you are currently driving without insurance? Might be a void thing in the policy.

call them up and ask them what the hell is going on. your car is not immobile and it is stupid for them to assume your car is a write off. tell them that they know your address so come and get an inspector out to assess the damage and get back to you with a decision. park it on your drive way and dont move it. if they come and tow it away call the police and do them for theft.

Ring them that's the best option mate...
If they take it away for storage, it will be to assess if it's a write off, or if it can be repaired etc. If it's a write off then they will give you the option to buy it back, or a cash sum. You can only retain salvage if you buy it back (eg. whole car) then break it etc.
I think anyways... :y:
EDIT: So it's a write off? Take it you got a cheque for it being a write off...?

i want cash and my salvage so i can fix it, get it retested and put it back on the road

Well after they declared it as a write off - they should have said "This is how much we'll give you for the car £XXXX, or you can have the car back for this price £XXXX which will be subtracted from the previous price".
That's what happened with mine anyway, it sounds like they just want to take it off your hands and store it somewhere. Just ring them to find out..

cant ring them till monday cos they shut, ill let everyone know on monday. so do u think ill be able to keep my car then? i could fix it for couple hundered quid, as i say ive been driving it all day, its got a cracked bumper and a pushed up bonnet. broken headlight and slam pannel a little bent.. i guess taht4 parts aint it so yea a write off, but i could ebay those parts.. for 300£ easy

10th May 2008, 16:08
did the assesor say what made it a write off or was that damage done more than your car is worth?
JC-Furio
10th May 2008, 16:10
They classed that as a write off, for the sake of replacing a bonnet, bumper, headlight and slam panel? Sure there's no internal damage, as writing off for that stuff seems a bit strange.
And you want cash + salvage, then you should have been offered this or a cash sum when they wrote it off?
gozzy-vtr
10th May 2008, 16:14
i dunno i rely dunno.. need to phone em. na no internal damage. the letter says they writing it off.. simple. thats all i no. but they telling me they taking my car.. they aint gonna be able to find it till i no why
JC-Furio
10th May 2008, 16:16
Should have been in contact with you; phone or letter to give you a reason as to why they're writing it off. Will either be because the value of your car doesn't equal repair cost, or for some other strange reason...?
And they won't crush it lol.

Cat C is not roadworthy i believe, and it means there's more than just damage to parts... Mine was Cat D and was costing somewhere in the region of £500/600 in parts to repair.
Not sure, but i thought anything higher than cat D wasn't roadworthy..?
gozzy-vtr
10th May 2008, 16:39
its proabaly not roadworthy.... but its drivable... it will be cat c cos a new bumper, bonnet slam pannel and light will come to over a grand at a ctireon garage sprayed...

At a citroen garage my repairs came to over £2000 lol. It was still cat D... If i was you, i wouldn't be driving it around, will be more damage than meets the eye at a guess. They won't class it as cat C - just for parts.

It sounds like when my first car was written off. The orginal place it was kept at was probably like a recovery yard and then they move it so that they can assess it make you an offer.

12th May 2008, 09:13
50/50 normally means that insurance companies just cover their own parties costs and not the other!
It doesn't mean that you will get a reduced payment!
However you may be liable for the car hire unless it was a part of your policy!
laura_g
12th May 2008, 09:13
why does it have to go to court i though it would just be 50/ 50 so you will have to pay half your excess
gozzy-vtr
12th May 2008, 09:16
na cos they gave me a hire car as apposed to a couretsy which is 50quid a day
someone needs to pay that. 50/50 means me and her.... ASRRAGGGHHHHHHHHH! gtg be back later keep thoughts coming please

You will have a full payout, but as liability is disputed, BLAME will be apportioned 50/50. Both parties will lose any no claims bonus and it WILL show up as a fault accident.
Do you have motor legal cover?

usually your insurance have a legal representative acting on their and your behalf like when i was insured with diamond they appointed Albany assistance to deal with the legal side, your car is still road legal i think so you are still allowed to drive it

If your 3rd party you would only get paid out if it was %100 her fault surely. If it was even a little bit your fault then you dont get any money
