rite, back in 2006 i had a crash in my saxo, golf ran up the arse of me, neway it all went through the insurance fine and i got a bit more back on the car than what i paid as it was a rite off.

now 2 years on i have had a phone call from a solicoters saying i am allowed to make a clain for any injury i had. at the time i was a bit stiff round the neck and shoulder area but just took paracetamol etc,

so i have started the claim as they said i didnt have to have doctor records or anything to do this, there is a minimum of £1000 pounds been put back by the other partys insurance incase of this. so what i am saying is if i win the case i can get atleast a grand. BUT i feel like i am sponging the money and i shouldnt have it. i dont no why i just do. th solicoters said the money is there for me to have as ihad a bit of injury!

What woul you guys do?

do it mate. if you've had the injury then take the money, £1000 at a minimum that aint come out your back pocket, cant complain really!

maybe you feel like your sponging because having abit of a stiff neck doesnt justify them handing over a grand

As a law student myself this is my opinion.

I would imagine the solicitors will want an extra fee for their work in making this claim, in fact its almost certain, your legal expenses will cover it if you have legal expenses cover and also if the claim hasn't been finished processing.

The other party will be aware that you are pursuing such a claim and will no doubt try and fight it; just because they have set aside 'x' amount of money for such a claim doesn't mean they are prepared to pay it, they are most likely playing safe.

If they contested it, you would probably be asked for proof of injury; and if you couldn't provide this, such a claim would fail.

In my eyes, insurance companies are a bunch of 'you know whats', the other party is unlikely to personally have to pay out, so if the solicitors are willing to chase this claim on a no win, no fee basis then i would have pursued it; but now that it is two years later i think that to do so would be taking the pi*s tbh and i think you gained from the whole thing anyway which is very lucky anyway if you ask me.

I would leave it and move on. - besides, is it really worth it? - but then again, i havent just been in a crash.

Take it, if you can have it easilly without any crap!

if you genuinely had the injury you are claiming for then its really up to you...if you didnt though and its just the solicitors wanting some quick dolla....id just leave it....dont understand why you didnt make an instant claim though??

dint make an instant claim becoause i dint realise you could claim on a bad neck n shoulders! until they rang me out the blue last week! it was purely the seatbelt that done it! they said it wud make the claim!

they are obviously telling oyu to claim for whiplash...which it dont seem like you had if you didnt know about it...moraly speaking...it wouldnt be right to claim...imo...

How can you prove you suffered the injury?unless you have medical records to back up the claim then don`t do it(I`m not saying you didn`t suffer whiplash)I had a whiplash injury & went to my doctor straight away their insurers paid out £1200.
