I don't normally rant at Police, in fact I have never but I am seriously wound up.
My brothers been on the road for about a week, on a moped and he's 16, saved up for ages for it, yes it's a ghey ped but still that's not the point here..
He's parked up outside a train station, his helmet is off, engine is off, peds on it's stand and he's just sitting on his bike texting his mate asking how long he's going to be
Then a Policeman on a cycle pulls up and gives him a £30 fine for being on a moped without a helmet
Seriously, wtf?!
The bikes off, it's on his stand, he's just sitting on it texting his mate as he's waiting to meet him. And he gets a fine for being in charge of a moped without wearing a helmet
What the fuck is going on, feel really sorry for him. I'm going the nick tomorrow to complain. I don't know what else to do but it's wrong..

ive chatted to some well down to earth coppers and have a bit of a laugh with them, but you allways get the bastards that think theyre too big for their boots

It is stupid that they did that, but they can do you for being anywhere in a car you have the keys too if your drunk....so id guess its a similar kinda thing...

Just read the ticket, says you can go to court so will go down the nick tomorrow and see what's what.
There's a list of offences on the back too
Apparently you can get fined for having more than 1 person on a push bike

otherwise pigs pay it. Seek legal advice. Based on what you've said it sounds like he didn't deserve the fine so it would probably be worth pursuing.

Train stations have CCTV get up there early tomorrow and ask for the camera footage of any external cameras (usually a few pointing at the taxi ranks) that way he will definetlly have proof if it come to court of turning the bike off etc.
It'll be hard to win a case such as this (or any coming against the police) But I would advise you to go through with it, especially if your brother is talking the truth. It'd be like sitting in a parked car without your seatbelt, hardly the worst crime in the world ;)

This is the problem ... things like this always seem to happen to people with no experience of what to do next. Copper sounds like a right prick ... I'd go down and contest tbh ... prob won't do much but worth a shot.

That is harsh as.
The only thing I can think is that someone on a moped get one over him or pissed that copper off and unfortunately he got revenge on your brother. I doubt he'll get much sympathy at the station, especially if he goes without a parent. But even then I think the chances are slim of a successful appeal.

Just opt for the court case tbh. I very much doubt it will actually make it to court. The CPS will most likely throw the case out before it gets that far. If they don't, the judge should do

that is harsh. Technically if your in a car / motorbike your classed as being in charge of that vechicle..... odd in circumstances like that.
Its the same if you were to get in your car whilst drunk and just sleep in it or whatever, and the officer has reason to believe your going to drive it, they could probably arrest you.
tbh i wouldnt even look twice, i see kids on mopeds doing that all the time, nothing wrong with it aslong as they arnt riding on pavement or giving lifts to their friends.
What code / reason is given on the ticket mate? Il look it up at work 2morrow.

This is written on the ticket by the officer issuing the ticket.... so you should have those details already.
