I had a crash on January the 15th 2008.

Heard nothing, just got a letter through and the people i hit have hired a solicitor and started legal proceedings....

Does anyone know what this will involve, court?

Pisses me off, money grabbing bastards, their car had a slight dent in the back bumper :(

I had exactly the same thing when they crashed into me cheeky gits!

Nothing will happen tbh, there just trying to get you cough up cash! stand ya ground!

I can only guess it's for whiplash? What was the crash like? big? bad? go through insurance? they'd have taken pics so if it's only a small dent then them claiming whiplash wouldn't be too smart lol

Nah no police, haven't even heard from insurance, this letter was from "Irwin Mitchell", it says they have not ben able to negotiate settlement with my insurance.

All that happened I hit them from behind after they jammed brakes for no reason apparent, their bumper was slightly dented......

They took pics, only tiny dent and few scratches, i didnt take any pics, so they could just smash it up to be honest :(

Have heard nothing from any insurance company, just says they couldnt negotiate a settlement, but i have heard nothing from my insurance.....

if they hit brakes for no good-will reason,surely your entitled to be compensated?was your car damaged?

If you hit anyone up the arse in a car it's your fault, unless you can prove they slammed them on on purpose, which you can't (i'm guessing it wasn't in the middle lane of a motorway with no cars around at all) your fault everytime...

Well when you reported it to them what did they say to you, and have you rung them since?

I didn't report it, was assuming they would claim. And 2 months down the line they hadn't even claimed, I also got my no claims! Don't know whats happening.

Should have reported it, if they don't claim nothing comes of it but your insurance is 'aware'. ring some people... find out what's going on. don't sit back and let it happen.

Well the letter from solicitors says legal proceedings have commenced and will be served upon me, they will send me documents shortly, then pass them to insurance.

Should of reported it tbh i would get on to your insurance company asap and see whats going on.

I'm afraid i honestly don't know, IF it comes out of your pocket you can come to an arrangement with them, but i'd ring your insurance just to make sure... although if you say no one has claimed then the insurance company won't have a clue or be involved.

Check what they are taking legal action over, why, if they claimed on the insurance. They've left it a LONG time, if they didn't go through the insurance then they won't have any proof it was you who hit them, i can't see it going anywhere imho.

yeah jan 15th. I just though I must be fucked, if they havent reached an insurance settlement then surely its all my money from there? And if i decline they take me to court?

You say the letter you got says that insurance couldnt agree a settlement...so you gave them your insurance details???
And if their insurance people contacted your insurance company, your insurance company would have got in contact with you to check your side of the story???

If your insurance company have been contacted by another insurance company, they would have got in touch, no question.

I had a similar thing with my first car, i reversed down the side of another car on a car park (i had only passed that same week!!)
anyhoo, i gave them my details, never had an accident before obv, so didnt know to take their details too!
Got home and told my mom who made me tell my insurance company.
they just said thanks and they would be in touch if they tried to claim.

A few months later, my insurance company got in touch saying they were trying to claim, turns out they had damaged the rear bumper somehow, and were using my details to complain, thinking it wouldnt be challenged.


So yea, they would have been in touch, so im thinking they are just trying to scare you into maybe giving them some money as an 'out of insurance' kinda thing.

tbh mate its bollock im still waiting for my car to be fixed a month and a bit later ! after the prick run in the back of me on the beach, 5 witnesses against just him and with him admiting that his breaks didnt work and it was his fault. unless ur fully comp insurance means fuck all !

say their brake lights werent working if it goes anywhere. if they had contacted your insurance they would have sent you accident report forms and tried to contact you by phone.
i'd say ure being taken for a ride, call this solicitors back and say "what accident? wasnt me" see what they say

Just spoke to insurance and they have said they offered some settlements, and said they were being unreasonable and it got declined. 2 people are claiming whiplash. So gotta ring the other legal part tommorow :(

i dont see how your insurers have offered a settlement without even asking you if you were involved? say theres no damage to your car and there wasnt any to theirs, and say their brake lights didnt work. basically accuse them of making a fraudulent claim i bet it will go nowhere after tthat

I had a lorry go into the back of me once, was really low speed, but i got wiplash, but because of the speed, it was deemed sort of my fault i got wiplash because if id had my seat and headrest in the correct positions, i would have been fine.

Might be an angle for you to argue from?

Well my dad did tell them when it happened, my bad. But yeah the other party has pics of my mashed car. Grr i shouldve taken a picture of their poor scratched bumper :n:

Sounds hard to prove though :( Ahh have to speak to law people tommorow, good news is direct line says it shouldnt make court, and they understand its probably just a milking scheme as they have offered 2 settlements. So may be ok :)

might seem difficult to prove, but if you think about it, the back of their car would have been pretty bad, so if its not still bad, it would have been repaired, so they should have receipts which will show how many repairs had to be done?

i was gonna say that sounds like too much bother, but then again, i wouldnt put it past some people!
they could of even had another rear ender and decided to put the blame on you.

Just gotta home insurance pull through for you on this 1, and remember it should (i hope you dont) you ever have another 'altercation' with another road user lol.
