View Full Version : Insurance got me confused.

Right a few weeks back my missus was in a head on accident on a single track B road. No one was hurt. Light damage to both cars.

Police show up and get all the details and come to the conclusion that no one is to blame as its bump for bump on a single track road. Missus informed insurance company that she was in an accident but she wouldnt be claiming and she will repair the car herself (she is 3rd party anyway so wouldnt get anything). Normal procedure is to inform the insurance company anyways.

Now this is where the situation confuses me, the woman in the other car has claimed against my missus insurance for the damage and personal injury.

Missus has sent the police accident report to her insurance company and the letter of personal claim from the other party.

Her insurance company is telling her that they will pay 50% of the damage to the other partys car? Is that right? Surely if it was bump for bump and missus doesnt want to claim on her own insurance and put the premium up the other party cant make a claim. No one was at fault.

I would be majorly pissed off if I lost my 4yrs no claims on a bump for bump accident that the police ruled no one was to blame. The car will take 300-400quid to repair max.

But they are also saying the other parties insurance company will pay for 50% of my missus car.....

It is minimal damage, insurance companies were just informed for records that is all.

I have spoken to her insurance company and they say this is procedure....its bullshit if you ask me. Told them she will be ending her policy with them and will not recommend them to anyone..

get your lass to claim for damages and personal injury also but off the other womans insurance company, i dont see how if she can do it your lass cant! i know its a bummer that her premium etc might go up but if the other woman has already claimed you might as well claim and piss her off like she has you!

ideally both off them would have fixed the cars themselves but the other driver is obv thinking they can get away with not paying anything

I think they go 50% of the other persons car on knock for knock

Mr ferrari driver and mr saxo owner have a slight bump.... who's gonna be more out of pocket?

So technically i think she'll lose her no claims

Would have been ALOT easier to avoid contacting insurance at all and just getting the cars fixed out of their back pocket

Well that was the idea. Its standard procedure to inform insurance company of any slight knock or accident. She did this and they made a note. End of.

Now this woman has thrown a spanner in the works claiming against my missus.

Can't your missus have a word with her, see if you can settle outside of the insurance or do you think she is milking it?

Obviously I know she is claiming for personal injury (which I reckon she'll be fine really) but I don't know....just ideas.

Thing is she is claiming for personal injury but refused ambulance treatment at the scene of the accident. Missus has contacted the hospital for ambulance records and a witness statement off the paramedic that offered help to the other party but refused.

Missus had a passenger who was treated for whiplash and bruises....so thats in our favour.

Seems that knock for knock settlement does not exist anymore....50:50 settelment is the new procedure. Wrong in my opinion.

Other party doesnt wanna put her hand in her pocket and has already sent missus insurance company her quotes for repair

The hospital refused or they have confirmation they other party refused?

Have records that the other party refused treatment from a paramedic...

I have told missus for her and her mate to both lodge personal injury claims against this other party and we will send all repair bills to insurance company.

Isn't the reports sufficent for insurance company not to go ahead with the claim? Surely you'd think if they refused it, they wouldn't have a leg to stand on.

This is what I hate about insurance, happy as pig is muck when getting your money but then arses when it comes to claims etc.

After doing a bit of research this is the easiest settlement for both insurance companies.

50:50 is a simple solution when no one is at blame and saves on adminstrative costs between the insurance companies.

Know any good sites for vehicle parts so I can price up a new bonnet and headlights and stuff. Then will drop it off at garage for them to add labour costs.

This shit is still on going.

Missus recieved a letter this morning from her solicitor saying she has to pay £185 to go on a driving improvement course and accept liabillity or go to court and fight it.

I really don't understand why we pay our insurance companies, they have literally given in because the other party wouldn't accept 50:50. Its an inclassifed road at the end of they day so it's going to be 50:50 all the sodding time.

I have told missus not to back down and take this thing to court just for the principle of it. Insurance company should cover legal costs. The police have also sent her a letter putting liabillity on her. Even though there dated accident report says no one is too blame. Wankers.
