Towel trick?
I would send it back but i cant find my receipt for shit.
If i swap the hard drives, is there any risk of the problem being transfered?

No mate, hard drive is not the problem, its cooling of the chipset...

Im sure they don't need the reciept if I am correct? Seeming as the Elite has been out less than 3 years.

I dont think they do, generally they can tell from the serial number how much warranty and where it was bought from...
I know a lad who sent his elite back which was flashed they still repaired it.

3 year warranty for 3 red lights for console purchased around launch time.
You can use your hard drive on a new 360 but any content purchased over XBOX LIVE will be tied into your old console meaning you will have to be connected to the internet if you want to access the content.

you dont need a receipt, they take note of the serial number on the console and send you the RMA labels. you pay for nothing except the sheet of paper if you get the RMA labels in email form. the courier picks it up at an agreed time and will deliver it back to you. simple as.
