Seen as Ive been on here for quite a while i was the other day going to post pics finally of the new saxo but as it happen a old lady decided to drive into the side of me on friday evening

Ive only had the car 2 months as well
My insurance company hasn't bothered with getting a quote there own repair specialists are going to pick the car up Tuesday lunch time and then hopefully fix it.
The best bit is the very old lady who crashed into me wants to claim on my insurance, i just laughed and said you've got no chance as you drove out of the junction into the side of my car its impossible for my car to go sideways but they said there still going to claim, also i was stuck in traffic so i have no idea how she managed to just drive at me and not see me (im thinking too old to drive). Now the door has problems closing as its all bent round the lock (maybe a new door then), and im quite sure i have a bit of clunking ( the mrs heard it a few times) coming from the front impact sides wheel when turning left wasn't there before the hit.
and Ive now got to pay the excess on my insurance £650 and £50 deposit on a curtsy car that's also coming on Tuesday major out of pocket before Xmas and i don't know when ill get that money back as the old people wont accept liability well yet.
So my question is as i have no idea how much this is going to cost any of you lot got a idea? It cant possibly a write-off... can it?

You will lose you NCB.
Claim off her insurance, get a no win no fee solicitor if you dont feel confident.
Exact same happened to me a month or so ago. Old man pulled out of a junction without looking. Drove into same place but further back (rear quarter panel), car was a write off. (Valued at 2,500). I claimed off HIS INSURANCE and got full payout for my car, got to buy it back for 250, and kept my NCB.

That would be nice but its going through insurance now i offered a settlement as i didnt want to go through insurance but they wanted to claim on me so its a garage job now

Got pics of her damage aswell (minimal). My mate passed a few secs after the crash and saw them both walking around we were all in traffic aswell so they got no chance. Her insurance will pay when it has been settled but ive got to pay for now

Claim Whiplash yourself, if she decides to be a bitch, why not you.
Tbh I think Old people should take a test every few years. Not an extensive test like we have, but a test showing that they are capable of driving.

If you turn your accident into personal injury it will take months.
Also it will up your insurance more at renewal, along with everyone elses. :n:

woah woah woah. she drove into you and your using your own insurance.
get onto your insurance and tell them you want to claim on her insurance as it was her fault and she is 100% liable for the accident. she drove into you not you into her. you said it yourself how can the car go sideways,. your mate could be used as a witness on the positioning of the accident and how the cars were placed.

same thing happend to me when i had my fiat.
woman aswell, thing is, it was a bright yellow car! how she didnt see me coming is beyond me - she obviously didnt bother looking.:wacko:
anyway - was a write off. bought it back for 100 and got a 1k payout. win win win.
do the same. claim off hers as thats the idea.:boxing:

you need to have her insurace deails then claim from her. then you will getyour excess back that you will have to pay.
its clearly her fault so you wont pay a penny in th eend
the rear quarter is bent i see?? so that may be a right off.
i smashed my saxo up christmas eve 2 years back.
that was the door, rear panel and axle.
that was a write off but i got it back and repaired it cheap

im as confused but thats how they do it unfair i know but thats what i have been told as they haven't accepted liability and i need my car for work. my premium wont be affected at all. the woman at the claims dept said if she doesn't accept it will be about 6 weeks usually until there insurance accepts ive got all the cover anyway you can get on the insurance like legal and curtsy car etc.

same thing happened to me with me colt an old lady pulled out on a roundabout and hit my passenger door i claimed whiplash and got 1500 which was quite handy buyin my new car lol

At the end of the day her fault so claim off her insurance. She was entirely at blame. I would seek legal help if you need it,

Why do you need to pay the excess on YOUR insurance(even if your getting it back), if its going through HER insurance? :panic:
I've had two non-fault accidents, never paid a penny and their insurance has paid out each time.

sounds like your doing it wrong mate
you need to ring up your insurance and say it was completely her fault.
If you were stopped aswel it is completely her fault you should have nothing to worry about. Make sure you tell your insurance company that you were stopped still if you was and she went into you and then claim on her insurance

ok just called the insturance and they said i would only have to pay initaly to get the car fixed and back quick then my legal cover would get the money back for me thats one option. I have just put all that off and im currently wating for th 3rd party to admit liabiltiy so i wont pay a penny and when they admit it was there fault ill get the car fixed and now it all makes sence.

this is how it works, if she is denying liability her company refuse to accept the claim so you use your own and they fight it out and get the money back. in a case like this it involves a lot of work and stress you wouldnt want to go through yourself, and the reason you pay for insurance so you dont have to.
anyway its not his fault, his insurer will get all the money back and there will be no record of a claim so no probs.
but i wouldnt worry at all, there is no way anyone would believe that accident was in any way your fault
