I got a leter today from the lawyer of te individual who took me off the road a few weeks ago. The company wish to settle this matter outside of court and have ofered me a 5 figured some. Sounds good..... But when i contacted my lawyer he said they have asked for the a quick settlement because new evidence had been found which mentioned problems with the van and implimenting them as negligent...sounds like this one could drag on smileys/sad.gif

sounds good mate but if they want a quick settlement theres always the chance you could be in line for more money because they don't want to appear in court.
i know someone that was off work for a while after a crash and he turned down the settlement offer several times (on his lawyers say so) and it kept going up because the other person didn't want to go to court either

They are prob offering it to you because they know they are in the Poo, If you take it they are almost buying them self out of it, Although it depends if you cant be bothered with the courts etc. if not take the cash if you think it is right, if not say more. otherwise take em to the cleaners, especially if there is new evidence.

when a drunk driver smashed into my mother 3 years ago (he had no tax or insurance it was a street car or something), they were trying to do it out of court and my mother was going to have £3000, however 2 years later after going through the court it etc my mother had £9,000 which paid for the car they wrote off and erm my private number plate lol

Hard decision i'd say
5 figure some is alot of money and are you likely to get as much from the courts? U could turn it down as said above and i can almost guarantee they will keep offering you more. I dunno what id do. Ofcourse u wana see this scum put down for what he did but wud you rather he was let of and you got an extra 5grand or sumit?

my saxo is stil in the bodyshp as i am not fit to pick it p yet. i plan to take the case to court for a few things but money is not one of them. The driver was drunk yes but he also had a small problem with the company vehicle he was driving...the brakes where fucked....this only came tolight when the police where testing the car to se why he didnt stop...the reason he didnt is because he couldnt. Im in a well earning job so the money is a little factor i want this place shut down for their negligence and nothing more

thats fair enough mate think most people will agree with you there. good luck with the case but don't think theres any risk of it not going the way you want it to
