View Full Version : Accident, not my fault, what to do?

I was stationary at a set of traffic lights and a car has come behind me and smashed into the back of me. I had three other passengers in the car, we all had seatbelts on.
now we pulled down a quiet road and the lad admits it was his fault etc. We swap telephone numbers to contact each other later on.
Now for the complicated bit, all of us feel a bit shaken up after the accident, two of my friends are complaining their necks hurt and feel weird including my own, my girlfriend feels dizzy and sick. Now i know it may be a little early to tell but it think we may have whiplash.
Now we could go to the hospital but the thing is, my right wrist is in a light plaster. I had a minor fracture a few weeks ago, im not taking painkillers as it does not hurt, i have been going on like normal and i am working. I also feel it does not affect my driving.
Now is it against the law to drive with a small light hand to arm wirst cast on?
if it is what should i do?

when you got the cast, did they tell you not to drive?

Nah they didnt mention it. It feels fine with no pain at all!
yeah i got his reg, and his dad came along and passed me his buisness card.
they didnt see my cast either as my hands were in my pocket.

You should be fine with just your wrist, would be a different story if you whole arm was covered in plaster

yeah i suppose, whats the best way about getting the car looked at/fixed. the whole rear end is smashed in and its rubbing on the wheels?

You are legally obliged by law to report all accidents to the police. If you do not you will not have an accident report number to hand to your insurance company to make a claim. This is fine if they wish to settle "out of insurance" but do you trust them?
Also if you have not reported the accident and gone to A&E for a check up you can foget claiming any whiplash injuries! They can deny the whole thing and what proof do you have, its just one persons word against another.
Do it by the book, police, hospital, the works, its safer in the long run!

Are you sure? I was in a car accident. The police were not called by any of us and there is no accident report number. The other drivers insurance company has accepted fault and I have been to a specialist about my back and neck and currently going through the claim

its best to go to the hospital if you think you may have any injuries and report it to the police.
that way there shouldnt be any problems.
if you dont thats when problems can occur with the claim etc

do you think they will say anything about my wrist being in a cast though? thats the only thing im worried about. Also how do i go about gettin my car looked at?
will the insurance company come out ad look at the car to see if its a right off?
if they do what about my undeclared mods?

Yea they should come and look at it and you should put your car back to standard. Not sure about your cast. Maybe call the Police and ask if it is ok to drive with it.

you need to put the car back to standard really otherwise they may refuse your claim.
your car looks fairly standard from your avatar. vts wheels should be ok i think as they are standard citroen parts. no 100% sure though.

Ive got the standard vtr alloys i could throw on, the car is lowered? its got a letaher interior? exhaust system? ( can change to standard) also has an induction kit?
i rang the hospital earlier ( withheld) i told them the situation and they said that whatever i go into the hosp for, in this case being whiplash. Thats all that gets written on the report.

anything undeclared that you can return to standard i would do. insurance companies will look for any reason to wriggle out of paying a claim.
if you have the standard parts, put them on, not worth risking a void policy mate!

yeah i will do mate, my dad seems to think that becuase im the victim, it doesnt matter whats on my car? is he correct? im also going to try and get my leather interior and doorcards out to, dont want to risk losing them. il get the standard from the scrappy.

Usually, insurers state that as long as your GP or DVLA say that you are fit to drive, you should be OK from an insurance point of view.

It depends on who you are insured with. With us, any declared mods are covered on a like for like basis but you will need to consult with your own insurers.
