View Full Version : Can I fight this parking ticket?

I got a parking ticket recently and it says 'time offense first noticed 1040' I didn't leave my house till 1050 and when i got out my car i looked at my phone because i was late and i remember it saying 1052. So obviously he has lied about seeing me at 1040. I appeal and they rejected it. Does anyone know if i can fight it? If I end up going to court and loosing will I have to pay the court fee's. It just doesn't seem fair to me that he can lie about what time he saw me and get away with it.

if its council dont pay, was in the paper around here about them not affordin to take so many people to court, so they dont bother at the moment

cant really help you until you tell us where the car was parked etc. was it on yellow lines / your drive way / parking space etc.

Yea its from the council. It's only £20 but the fact the traffic warden lied annoys me.

It was in a car park area and they have a little machine you put coins in and get a parking pass for a certain amount of time.

say the machine had a sign sayin out of order on, and other cars around didnt have pass things in the window...
or ignore it, chances are the council cant afford to chase £20 up at the moment

Have you got someone like a friend who knows that you didnt leave till 1050? As they can back you up

so your ticket ran out of time at 1040 but you didnt get to your car until 1052? if thats the case then theres not much you can do as the time expired.

he didnt park there untill 10.52

ah right, well in that case do you still ahve the ticket with you? it should mean that they gave you a penalty when there was still time left for you to get back, you can use that to appeal.

he didnt get to the parking space untill 10.52, but he got a ticket, saying it was issued at 10.40, when his car wasnt even in the parking space...

From the ticket that was give it looks like I had been there for 15 minutes which is enough time to go to the machine and back. In reality I didnt get there till 1052 and was issued with a parking ticket at 1055. That gives me 3 minutes to get a ticket, which i never got.

Yea, My mom was going mad because it was 1050 and I had not left. She wrote that in the appeal letter.

Basically. It says first time offense noticed 1040 and ticket issued at 1055. So it looks like i was sat there for 15 minutes but i had only been there for 3. I'm sure writing down wrong information would void the ticket?

i would write back and say youre not paying this ticket, and should it get to court then as mentioned in your first reply, a witness is willing to tesify that you were NOT at the car park during the period of 1040 therefore the ticket officer in question had the wrong time. also if the car park ahs CCTV, you can also put into your letter that cameras operating at the time will provide further proof that you were not present at 1040 but let the council be the ones to get the footage as it will mean them spending more time and resources for £20.
