My girlfriend had a car accident in tesco carpark an elderly man in a lexus reversed into our renault clio out of a parking bay whilset she was stationery and now the insurance want me to pay the £650 excess (as shes only 18) next week as thats when my car is fixed they said it would be recovered from the mans insurance when he accepts liability the problem is i cant afford to pay them the excess in the first place as its just after christmas

tell them you dont want the car repaired until he accepts liability, as soon as he does you wont have to pay the excess

If it was totally his fault, you shouldn't have to pay a bean! His insurance should cover everything!

if someone crashes into you their insurance wont just issue you a blank cheque to fix your car, there are proceedures to take so most of the time its much quicker and probably a lot easier to use your own insurance and let them deal with the nightmare of getting the money back.

ins company should pay for damage then recover cost from either him acceptin liability or you if if were to be found he wasnt liable, but ins should cover first then recover costs, refuse to pay!

its an excess that is agreed when you take out a policy if you just refuse to pay it thn they wont pay to fix the car, but as said as soon as the other guy accepts liability you dont have to pay the excess or if you have paid it you'll get it back

why are you getting the car fixed before liability is agreed? is the damage that bad?! as LeeM says, tell them to get the car fixed once liability is accepted. Your insurance company are just trying to cover their own backsides. They dont want to carry out the repairs if there is a risk they wont recover the costs, and at the moment, they only have your word on it.
If you think this guy is gonna play silly buggers and is unlikely to accept liability, go down the CCTV route...but do it sooner rather than later coz they dont keep it long!!
