View Full Version : Informing DVLA that car is written off!??

Hi all, looking for some advice please people...

My girlfriend had an accident last year (September) and the car was a write off. She went into hospital for a few weeks and with all the communication between insurers, courtesy cars, doctors etc we never informed the DVLA that the car had been in an accident and wrote off. Weve now received a letter saying the car hasnt been taxed and if its off the road were liable for a penalty since we never told them - which is a load of b*ll sh*t if you ask me!!! Anyway, we no longer have the V5 form as the insurers needed this so that we could claim the value of the car back, and to date they havent returned it.

Now even if we get form back and send to DVLA are we still liable to pay the penalty? If we pay by 16th Jan its £40, but by the time weve contacted insurers and sent to DVLA with our explanation this date will have passed and the penalty will then be £80. If theres no getting out of this we may as well pay the £40 fee and be done with, unless we think weve got a valid reason for not contacting them!

What you all think???

they did exactly the same thing to my sister.

i think she ended up paying as they said she had to prove that it had been sent, which she couldnt obviously.

i would ring your insurance and explain whats happened. if its their responsibility to inform the dvla that the car has been written off then they should sort it out and pay the fine.

you will probably find the insurers have destroyed the V5 document if it was a full value claim, you will have to phone the DVLA and explain the situation

uh-oh...iv just sent my v5 off to my insurance company coz my car was a right off. does that mean i will have the same problem 12months down the line?? tbf, i had a letter from my insurance company telling me its my responsibilty to tell the DVLA its a write off!! luckily, i sorned my car whilst it was sitting outside my house. does that mean im off the hook!??

Ye you should be fine for another year if youve sorned it already. When they ask again tho u'll have to tell them

I sorned it back in August (to claim some of my road tax back). can i just keep sorning it!?? lol

Found this page on the DVLA website, looks like you should complete part of the V5 form & send back to the DVLA.

uh oh ive written of 3 cars and never informed them of any! i can expect some fines soon then i suppose!

£80 up to £1000 - :panic:


the accident was last september and we sent the V5 form to claim company for a settlement cheque. kinda thought they'd contact DVLA since they have all the info. just goes to show there always someone out there trying to shaft ya!

You will need to prove who actualy disposd of the vehicle so as not to be liable.

and yes i know what im saying

i visit the dvla daily and do £1 million pounds of transacations with them for work each month

i had this problem sold my old vtr to a boy in birmingham he wrote it off the same day i sold it to him and they are tryin to do me for not informing them that it was written off. want me to pay £55 and if i dont pay that i go to court even tho its not my problem because i sold the car on
