im learning to drive again as i have been banned, anyways my bans been up for ages and someones reported me for driving my car over the weekend (even tho my cars been at the garage nearly two weeks now) in a wreckless manner, and was ment to have been driving my friends car aswell (which is also a heap of shite as i wasnt even out over the weekend) but anyways the police came to see me about it, and did a record check on the dvla and it came back saying i am disqulified, and my car isnt insured as i cancelled it because i put the vtr engine in and waiting for the logbook to get changed, so anyways the police said theres 2 witness`s and it was def my car at was seen driving around and me driving my friends car, so ive been charged with:

driving while disquilified
no insurance
no L plates
no co driver
driving in a wreckless and dangerous manner
and driving a car not belonging to me

the thing is tho its all a lot of shite am NOT disquilified as im learning to drive again, i wasnt EVEN out over the weekend am soooo pissed off right now :wall:
i also phoned the dvla this morning and asked them about it and even they said im not disuilified from driving, so what can i do about this and where do i stand about pressing charges to those "witness`s" for false accusations :n:

oh yeah my friend was also out in inverness on friday and saturday night and stayed in a hotel up there and his car was there with him!

you will need to find people who can vouch for where you were over the weekend

and ask for some physical proof that you were driving your car.

yeah i was in my house my mum dad and brother were here as me and my brother were playing cod5 all weekend to complete it, a lad i know works in the coop, and he said the police was in to look at the cctv footage and it showed no evidence of my car or my friends car going around at anytime but yet i still get charged with it, going to phone up my solicitor in the morning and going to go tell them whats going on :n:

im not sure buddy but it should be on the records that my friend was staying there over the weekend as he paid for a room for 2 nights

if your car is in a garage then the garage can vouch for it.

your friend will have recepts from being elsewhere aswell.

yeah the garage will my dad knows him very well and my dad phoned him and told him what was going on and even the garage said my car is inside on the ramps and hasnt moved and hel stand up and say that, yeah he will have proof of being else where aswell

aye i am cracking up to be honest but cant really do nothing untill i see my solicitor, cheers every one, will keep yous posted and updated with what goes on, my parent are wanting to go to the papers and put in a story about me getting falsly accused so might go a head with that aswell once i find out what happens

it looks like you have a solid case.
if your mate was away, your cars in the garage, you have whitnesses, also the CCTV shows nothing then it looks like you will be ok.
pretty harsh charges tbh

If you can get proof as mentioned above you should be fine, no way they can do u if your car was in garage and mate was away and you was in all weekend...
id ask for names of there "witness's" they say they have, probz wont give you them tho haha

Everton striker was arrested on suspicion of robbery even though his leg was in a cast iirc.

I meant the opposite about COD5 mate, hours to complete even on hardened.

cheers guys yeah i have witness`s and that to say where i was at all of that got my solicitor on wed so will find out then, i also found out tonight whos done, its a local guy on the main street who doesnt like no one driving about and reports everyone if they drive past his house :n:

Seriously though, I would speak to the DVLA again and the Police and make a complaint if need be.

Get your mobile phone records. Whilst your phone is switched on, to the police, its like a human sat nav. - This will prove where you were. You need probable cause but i think you have it lol.

Go to court, tell the police nothing, and be smart about it.

Your primary goal here is to get some SOLID evidence you didnt' go out, your mates car wasn't anywhere neer you and your car hasn't moved.

Then once its all over, go around to the guys house who reported you and set fire to it.

as people have said, GET evidence that you were elsewhere to help clear your name. once thats done, reverse the role and sue the other party for false accusation, psychological trauma and loss of earnings to see how they like it.

makes me pissed off how police don't give you a chance if you drive a modded or sporty car and just take the other party's words against yours. i would definately sort it out today i know quite a few people who have had their cars towed away and shit like that just because some busy body cunt didn't have anything else to do but report someone because someone is enjoying something.

as said down the police station and tell them your mum,dad and brother will all stand up in court and say you was at home...

These two points will be strong enough,

1. Your cars in the garage, your invoice would act like a release date for the car right?
2.Your mates in Inverness, how can you drive a car that wasn't their?

Case dismissed....... Then counter claim compensation for it being a ball ache, maybe even a tad of harassment against the old guy.

was in to see my solicitor yesterday and shes told me not to worry about anything as the proof i have will get everything dropped if it does go to court, but she said she will try and get it all dropped before that happens, so was asking about filing a complaint against them for false accusations and she replyed if i do that they could say "hey thought it was me, my car etc" and nothing will come out of it. tbh tho im just happy all this shite is getting sorted out, the guy and his wife that reported me has also reported heaps of other local people (one of them got an asbo when he was "driving like an idiot" on the main street, but he was at the cinema at the time with a girl so there going to court to fight it and looks like he could win that aswell

well just got a court letter in today got to appear up on the 28th of this month 2 charges against me:

1.driving while disquilified
2.driving with no insurance

pretty pissed off to be honest, but my solicitor knows everything thats been going on and told me not to worry as we have enough proof its all bullshit and i wasnt out at the time, but i am going to fight this all the way and get the so called witness`s charged with making up lies etc
i even got a written letter from the DVLA stating that i am NOT disquilified from driving, and before anyone comes on and starts shouting / slagging off read the whole storry first

Sounds shit mate.

As said, dont worry.

If your innocent they can't prove your guilty.

Chill, relax, let your solicitor do all the hard work.

I'd look into turning this around and sueing the 'witnesses' for false accusations or whatever. Even if nothing comes of it. There will then be a record against them about it and the next time they grass an innocent car enthusiast up they won't have a leg to stand on.

thats a bit of a shitter mate. had the police at my door once as some dickhead had crashed his car at the top of my road and there were reports of a yellow saxo "racing"

needless to say, i was tucked up in bed and not happy! thankfully i had an alibi so they soon scarpered!

edit: get garage to write a letter stating how long car has been in garage, mate as alibi, it'll get dropped in count tbh, countersue them for harassment regardless of outcome!

actually, sue them and say the bloke touched you lol
