Well guys the Type R was just seized
Decided to take it off me for so called wheel spinning :S
So the story as ill add due to some people saying its me etc
lights are on red,im the first car,there are 3 cars behind and they are my mates
So i pulls off and turns left,the others went straight on.
Copper comes
Blue lights
I get out
You wheel spun,section 59 im taking your car

They also said i was given a section 59 last year which i 100percent didnt happen
So i offer to pay the recovery on the spot the coin

Section 59 is a good and bad thing at the same time, it's mainly used for chavs at cruises etc acting like, as it's a small charge they don't really need much more than the officers say so which sucks ass!
It is on the driver not the car, also iirc upon getting a third section 59 they actually crush your car!
You wanna get this looked into matey!

Car seizure warnings (Section 59 Police Reform Act 2002) are NOW issued to both the Vehicle (no matter what) and the driver !
correct! any motor propelled vehicle can be issued with a section 59 :bored: as well as the driver... and that carries over to the driver driving anything else and anyone driving the vehicle it is issued to!
You should have been told that you are/were issued with one and you should have been told with the conditions of it. As well as being given some form of paperwork for it (well thats the Met policy anyway)
Its a two stage thing; First the warning, second is taking the car/bike/whatever away... usually not three strikes. And it is active for for 12 months from the date of issue.
If the previous owner was issued with one and didnt let you know that could be your way of getting out of it.
Tbh, you will probably have to pay the fee to get your car out first, then contest it

its simple to go down the station and find out whether the old 59 was on the car (and prev owner) or the current driver. You have a dated V5. Its easy to sort then if you truly are innocent...
If the old section 59 is on you then i dont see how you can forget.....

if you havent been issued with one in the passed they should be able to check... Do whatever check they do to check section 59's and the check the car on the police national computer... see how long you have owned the car for and when the 59 was issued...

Section 59 Police Reform Act 2002 states that -

initially give a written warning (valid for twelve months)
(commonly called a Section 59 Notice)
and on a subsequent occasion to seize the vehicle.
(it will probably end up in the crusher, or may be ransomed back to the owner)
A constable in uniform has the power to order the person driving to stop the vehicle, to seize and remove the vehicle, to enter any premises on which the officer has reasonable grounds for believing the motor vehicle to be and to use reasonable force. Seizure can made only if a warning has been given, or believed to have been given, or if a warning is clearly being ignored.
So, usually it's a two-stage process - a warning or notice first, seizure if you persist or repeat.

indeed... I've heard a couple of times people have had their cars taken off them... They have had s.59's but the person actually hasnt been issued it... the officer has just sorted it out at the station... well so they say.
Something must have been done to make the officer want to take the car off you... if you havent been issued one then the only thing I can think of is the previous owner had one and they just havent told you about it.
Just dont go to the station/car pound f-ing and blinding as that just wont help and the next thing you know you will be slapped another fine for public order or something
And the warning does go to both vehicle and driver/rider

there was me and infront of me a copper and infront of the copper another car, the car had turned off and i was still going 60 < the SPEED limmit but the coppers dont think the speed limmits apply to them! it jsut annoys me casue if i chased after him i would have been done for dangerouse drving!!!

So i goes to collect my car today and the answer was no
you aint having it back until we get a fax from the police
Asked the police and they say i have to wait until 10pm tonyt for the officer to come on duty to speak to her
so thats another 20 pounds a nyt to get the car out tomorrow
The police officer told me that i can 100 percent get the car first thing
ive travelled 30 miles to get the car to be told no

Iv been pulled over a few times now for being in the wrong place at the wrong time.
How can they give you a section 59 for wheel spinning, it sounds a bit petty to be honest. They should be given to chavs booting it round mcdonalds car parks on maccies trays and things like that.
I have never had a problem with the police though, i quite like the ones by me. (but these seem to be complete arseholes)

I do like the way they cover themselve if they fuck up and accidently take your car and crush it they can say they "believed" you'd been warned.

Like mentioned before like most people Ive had the odd run in with the fuzz but in my experience most are fine as long as they are treated with respect they are fine.
That doesnt mean there arent utter wankers out there like there are utter wankers in modded cars so its alot of give and take.
I hope you do get your car back ok, and if you do decide to make a formal complaint then Id try and be as cival as you can and try no to get worked up or lose your rag or Im sure your complaint will slip off the desk and in to the bin as soon as you leave the station.

if you have never recieved any paperwork qith anything to do with a section 59 you havn't got one. i was threatened with one once for absolute fuck all so i spoke to a friend who is a police officer (nice guy) and he said even if they say there giving you a section 59 notice but they don't produce any paperwork its not valid=D
That is absolutely terrible.
How can they justify that you have to wait for the officer to come back on duty?
What if the said officer was now off for a few days? Would you have to wait until they came back from holiday and then pay for the fact they haven't completed the paperwork.
System is a joke ... Discriminates massively. Obv if you've done something wrong then fair enough, that's your fault. But I doubt it, you're not a chav.

Yea as others have said really, you've been shit on by the coppers here mate. Some are decent, some are pricks. I have a few mates who are coppers and they all say they do an attitude test when they pull someone over, basically, if you're a knob then you're getting done.
You'd be able to claim any additional charges back if their incompetence is costing you extra money. Speak to a solicitor or citizens advice etc. as making you pay extra money because she hasn't done her job properly is a disgrace.

i have had my car taken and both where for things i didn't do.
i was caught racing according to the officer in a micra :P i thought he was joking but he wasn't gave me one for that, his reasoning was because there was a group of us i was the one in front must have been racing :S
second one was on my gti when i had it, car got taken now this is where it gets really stupid
meet some mates near a roundabout theres an area where a few people hang out.traffic cop pulls up about 2 mins after me and calls me over says i was, and i am not joking DRIFTING ROUND THE ROUNDABOUT!! IN A 106 LOL
the description of the car was a dark hatchback that was it got the 59 and then £150 lighter.
wasn't happy and went to see a soliciter as i really wasn't happy and the guy looked at me and says sorry mate have had a few of these and it's legalised theft nothing we can do!!
now with the 1st i can maybe see the reasoning but the second hacked me off big time, gave the traffic cop what for even told him about the difference between rwd and fwd as obviously he didn't know.

So as of monday im going to claim the dole until i get my 150 back and 20 pounds fee to get to the garage to collect
so i month on the dool will sort that out

im not a fan of the rozzers myself, not when they beast everyone at a meet or cruise for no reason there are some decent ones about but its very rare lol the whole justice system and government and law are all corrupt.

reminds me when they took my van said it looked dodgy smashed window to get handbrake of then dragged it onto a tow truck busting the rack and power steering then at there compound bent the back doors open to see what was in it yh tools am a joiner it was left in the county middle of no where for 45 mins parked up locked insured taxd motd yet they think its nicked or some thing lost the 4 years no claims on it cost £500 excess and got sod all back its going to court now WANKERS
then had to fork out to get it fixed

My mate ran out of petrol. Left his car parked perfectly legally, was taxd, insured, mot'd. etc. Went to collect it the following morning, gone. They wanted 170 quid to get it back which he didn't have. Car was crushed.

there are alot of police that are wankers out there, but there are some sound ones and as long as your careful and dont cause any harm to them or any other people they are normaly fine :A: i have been stopped a few times and they have just gave me a harsh telling of for going round roundabouts to quick and attempting to do a handbrake turn in my old fiesta in a car parkk hah :A:

In terms of Doll even if you don't need the cash if your out of work for longer than say a month you should sign on as you wont be paying into you National Insurance which relates to your pension amoungst other things.
Well hope you get your claim in and get your money back but I wouldnt hold your breath...

If there was only one police officer in the car, your car wouldnt of got seased with out camera evidence, in court the officers word counts for exactly the same as yours does. id apeal the fine, your word against her's, she cant make it stick one bit.

A mate of mine has a civic ur shape... but a 1.6 sport... n that has launch control.. and it doesnt wheel spin at all... if u have u should just say i had that on and theres noway i couldve wheel spined lol..

im going to have to argue with you on this one of my mates got smashed into by a drunk driver, i was present straight into the back of his car wrote his 5 hour old car off lol, they took off up the road i gave chase on foot shouting abuse thinking it was theiving chav scum.
i caught up heard a bang and theyd smashed into a parked van ripped the front wheel off then i saw the reverse lights come on and the car trying to get away but not getting anywhere, i ran right up to the car ready to beat the shit out of them. (this is the amusing part sort of) was my cousins ex mrs driving with 3 mates of course by that time i didnt know what to say and i couldnt be angry she was crying blardy blar and extremely sorry but ill cut the story short.
she was drink driving and got scared and tryed to drive off TWICE, i dont care who she was, this could of been one of those what if they hit your nan or kids and shed of still done the same tryed to drive off and could of killed somone.
SHE GOT 6 MONTHS BAN FOR GOING ON A DRUNK DRIVING AWARENESS COURSE, and HERES THE PISSTAKE, HER LICENCE STRAIGHT BACK.
SHE GOT AWAY with DRIVING OFF in court and her licence handed back to her straight after 6 months.
now ill give you a scenario me driving down the motorway at 110mph(fastish but driving perfectly safe at that speed TAXED,MOTD,INSURED all legal)
i get pulled by the police itll definately go to court ill probably get at least a 12 month ban and heres the laugh, ill DEFINATELY have to retake all of my driving test all over again.
so ive not tried to drive off, not even caused an accident, just been speeding and i face harsher penaltys than somone who was drunk driving, actually caused an accident then tried to leave the scene of an accident that could of killed somone. that is not right at all.:wall:
but point is she did get done what should of been the book thrown was a little slap on the wrist, and this guy here with the civic has ended up paying out more on this load of bollocks than what she did.
so its all good checking cars but thing is most of the targetted cars will be us lot who probably are all legal they wouldnt check a car like my cousins ex whos never been in the car scene and the standard cars probably commit more offences than any of us lot do.:n:

Good post, very good point too mate, I see 100% where your coming from, It's just so many people needlessly abuse the police, because they're 'the police'.
I like to think of it in similar terms to building/contracting (for example). You have a bad job done by somebody, and it isn't instantly "oh all builders are wankers" or "no builders do their job properly", most people will view it, as that individual builder is the "wanker" who "can't do his job properly", not stereotype. Where as with the police, one bad experience with one policeman, and instantly all police are the spawn of satan.
Yes there are a lot of Police around that aren't fit to be Police IMO, but I don't think it's fair to slander the reputation for the ones that do their job well, and are trying to serve the community.

a 1.6 civic not wheelspinning isn't down to having launch control....
it might have traction control. my civic does, i think all the new ones do.
ep3's dont have traction control, or my brothers 55 plate didnt
