Ok,so when i bought my golf,i made a "deal" with the prev owner that i;d give him the Weber 32/34 carb back that was on the car, said it;d be a few weeks etc.Past few days he's been a total cunt with me demanding it back.So tonight i get a text of an unknown number"hi mate, you still got that carb,i wanna buy it off you.I'm next 2 your car now"
I was like...ok WTF?
Look outside and there he is(prev owner) looking in the car,and he then rips the VW badge off my grill, and opens my bonnet.I was outside like a shot" can i help you?"
"Where the fuck's my weber?"
"In the unlocked boot, have fun under the bonnet?"
"Ye,i want it now"

Gave it him,and he checked every last little nut screw and bolt.I'm stood there with a wheel brace in one hand, and a hammer in the other.

Now,he's been banned for dangerouse driving, and is known to the coppers. Can i effectivley get him in the shit for attempted theft?
His prints are all over my pass door handle(dont work, never has) and my bonnet.

if i find ANYTHIGN wrong with the car in the morning, the coppers are getting a call.
He was very nearly sent down for his behaviour when he was done for his driving,so i doubt they'll be leanient with him

Should of just given him the carb before you took the car off him really tbh would of settled the problem really.

Theft probably not as he can say you made an agreement, not that theres any evidence though.

But vandalism maybe for ripping the badge off the grille if it did any damage and will be costly to fix?

I wouldn't report him (sounds sorted now?), seems like the kind of person you don;t want to get involved with.

Well really he shouldn't of sold you it with the carb if he wanted to keep it he should of removed everything he wanted to keep before he sold it to save confusion, but those dents are crying out to be reported ;)

Attempted theft isn't a crime

Of course it is, how ridiculous.

If someone breaks into a house and tries to steal something but gets caught, its called attemped theft. You go to jail. :S

I wouldnt bother reporting anything. If someone smashes your window and nicks your headunit the police wont even bother attending they just give you a crime number for your insurance. You might have a chance with a criminal damage claim but the police wont be very interested and to be honest by the sounds of the guy it would be more trouble than its worth.

No no, that's breaking and entering with a further charge of attempted burglary

So the further charge is STILL attempted burglary, i.e. attempted theft from a home.

Thought attempted theft wasnt a crime ? ;)

Also if you have a record of ccar thefts, you can be arrested on suspicion of attempted car theft.

You dont have to actually steal anything, but thats if the guy had previous records... He could still be arrested for criminal damage to M1VT's car and attempted theft...

Merely basing it upon when someone was trying to break into one of my mates taxis they couldn't be charged as they didnt break into it "There is no such chargable offence as attempted theft sir, shoulda let em break into it"

If he broke into the car, i.e. broke open the bonnet and/or boot, and was stopped and arrested before actually stealing anything then he would be arressted for attempted theft, cos he attempted to steal but got arrested ;)

If he's know to the fuzz for this kinda behavour whos to say he wouldnt come back if the fuzz tried to talk it over with him. It all sounds abit dodgy I think Id simply put it down to experience and keep a close eye on the car for the next few weeks

Bonnet was unlocked tho, dunno if that similar to the laws with unlocked house doors?

At the very least tho you can get him done for vandalism/criminal damage with the ripping off of the badge?

goodall3518
22nd July 2009, 18:12
Definite charges for criminal damages.
