I know a fair bit about these parking charges. let me just say that PRIVATE PARKING CHARGES ARE FAKE AND YOU DONT HAVE TO PAY THEM.

theres a difference between private car parks and council ones, and as it was a tesco car park im 99% sure its a private car park (e.g. eurocarparks which are a big one). tickets you get off these private companies have no legal meaning at all with the court, with the police or anyone... places like tesco will give you tickets that look like proper police tickets to try and make you pay them. they will put things like PCN, FPN or something on them and the yellow and black stripes to make them look legit, they will also use a really formal and threatening tone and lots of references to law to try and convince you that you really do need to pay this ticket or youre fucked. They try and scare you into paying, try and make you think "well its shit but its only 30 quid i wont risk anything more". most people will not think theres a difference and cough up.

just completely ignore it, throw it away or something as theres nothing they can do. You could appeal but as the company handling the appeal is the same company that would benefit from you paying the charge, you can guess what your chances are.

if I get a ticket I'll just throw it and forget... if you just ignore it most of the time you wont hear anything back at all, some of the time they may send you a threatening letter or two and the odd one will keep on pestering. What they do is buy the "registered keeper" details from the DVLA which has your address and name, then they use that to send you letters.

If they keep bothering you (none have with me), then you could get in contact and say that as you were not driving the car you are not liable and that they should get in touch with the driver of the car and stop bothering you. They will probably say something about a contract was formed when you entered there premises or whatever and that the registered keeper is "liable for the parking charge" which is complete bs. If they do this just contact them again then tell them that you were not driving the car so you are not liable and they are wrong, and say that if they continue to send letters you will file for harrassment. After this they will get the message and know theyre not gonna get anything out of you.

The registered keeper is only liable if the ticket is a proper FPN, PCN notice etc set by the police/council. I never contact them at all, not even to tell them that im not paying, as they are not worth the bother.

But just in case you are intimidated by their threatening looking tickets/letters and think they might do something nasty to you just read this: in order to do anything to you in the first place they need to take you to court, then they need to PROVE that you were the one driving, PROVE that theres a contract (proper signage and stuff everywhere), PROVE that by you parking there you were preventing other customers from access costing them money, and even after all that their charge to you has to represent the cost to the company of you parking there, which is probably nothing like what is written on the ticket (a few months back i got one for 70 quid increasing to 120 quid after a week, what a fucking joke).

But you dont even need to be scared of anything because they will NEVER take you to court or in fact do anything apart from sending you threatening letters. So don't worry and dont pay. As you can probably tell I get tickets all the time. as a guess i probably owe a grand or two of these imaginary "parking charges", never paid a penny tho

whew long post, hope it can save some of you a few quid from these tossers who will try and steal your money. if you have any doubts about this post then just ask

well im pretty sure if the fine is not from the council you dont have to pay it. a friend of mie got a fine for parking in a morrisons carpark, her dad went to his solicitors and told them, they said it dnt need to be paid and sorted it. she got no fine

AXracing
24th July 2009, 21:56
YES!!!!!!!!

There is a very easy way to get you out of most parking fines as long as there not government fines.

WARNING!!!! DO NOT TRY THIS WITH A GOVERMENT FINE!!!!!!!!

Privet parking companies can NOT issue fines to car owners. It is illegal for them to do so. What they can do is issue fines to a driver. This is a very important aspect.

When you get you letter from a privet company informing you should send a letter in reply clearly and nicely saying something along the lines of than you for your letter and that you understand why they sent you the letter as you are the registered owner of said vehicle. However on you were not the driver of the vehicle and could they kindly no longer contact you on this subject.

I privet company has no right to make you disclose who the driver was. It will likely end at that as any further contact to you would be harassment and unless they had a concrete case against you.

Again do NOT try this with government fines as it does not work and will get you in potentially even more trouble!

Handy to know stuff like this ;)

Thanks Claff, this is good advice, so, you're saying (although not necessarily recommending), that you can park anywhere you want, in disabled (questionable ethics for some)/mother and toddler spaces without fear of being fined?

Well, consequence in that, if you do get ticketed, it's not enforceable, unless they have video proof, but it will never get to that as I imagine that's a waste of resources etc?

So you didn't want to get wet, so you took up a bay designed to be larger in order to aid minders/carers to easily place somebody from a car into a wheelchair.

So assuming this person can not use the bay now, they have to go looking for two spair spaces side by side so they have enough room. In order to find these spaces and ensure they are still free when they return they end up parking at the right far end of the carpark.

So basically, because you didn't want to get wet, that little old woman in a wheelchair and here carer are now drenched to the bone, she gets pneumonia and is rushed to hospital....

Ignorant as it was to park in a disabled spot you wont have to pay this as it is a PRIVATE car park.

I was picking someone up outside Tesco here and parked on the main road on double yellows. Along comes plod and gives me some verbal......

But says "next time stop right outside the Tesco door"

"Ummmmm" says me "isnt that the same double yellows there?"

"They dont count" says he "PRIVATE PROPERTY"

Take note, on the same vein you are not insured there either

Parking in disabled bays to me depends on what time of day it is. I would never park there in 'peak times' as I know they are needed during those times but when I go there in the early hours of the morning (like after midnight to about 4am lol) then as long as I wont get fined for parking there then I have no problem in parking in a disabled bay

As pointed out by a few on here.

Parking in a 'Non' council regulated carpark, is classed as a private carpark. You can't get a fine from a 'Private' carpark as they can't be upheld in a 'County' court of law, they can however take you to the small claims court to get the money. But they then have to prove you was the one driving the car and not the owner of the car.

Oh and by the way, if the private company send you out a letter. You have a right to claim under DPA (Data Protection Act), as they are not legally obliged to obtain your information from you number plate and enforce a fine.

As for these spouting there mouths of about you should be ashamed and all this balls, its a bit of paint in a 'non' council regulated car park and means nothing.

There's a difference between a bit of paint, and a bit of respect. I'm not ashamed in the slightest on what I said, and you can't get all high and mighty. I'm sure they would love to not be disabled, but something in their life has caused to be. Let's say a soldier was injured in the war and has to use a wheelchair, he can't get out because some idiot who's perfetly abled walking and didn't park 5 metres away because they have to be as close to the store as possible as they are too lazy to at least gain some fitness to walk these extra 5 metres.

I don't speed no, and have you ever sped in a car? And also I bet not everyone speeds intentionally. I bet you can't accidently park in a disabled space, unless you were that blind. I don't care if 6 other cars had tickets on, you still parked there and you can't justify it to me. I'd never think about parking in a disabled space even if there were 100 empty spaces as I know that you can get tickets.

ive obviously offended you in some way and for that i am sorry, as funny as it may sound to you but sometimes people do the odd "bad" thing or something they shouldnt have done. That must be beyond your comprehension as an upstanding moral citizen. it not like im some little rudeboy chav giving it large and acting like a complete cunt!! i made a mistake i parked somewhere i shouldnt as i didnt think that for the 5 or so minutes i was in tescos a fucking convoy of blue badge holders would turn up.
I like how when people do something wrong they try and mock you. You didn't make a mistake, a mistake is doing something by accident/not meaning to.
