Right basically i was driving down the road as you do when a lorry pulled out of a junction without lookin and sent me flying into a kurb. He accepted everything was his fault and hes sorry bla bla bla.
Whole side of my car was damaged so i decided i wouldnt drive the car untill it was fixed and im not mechanicaly minded so i wouldnt have a clue if anything was damaged underneath the car.
After the wait of his insurance to accept liability of the crash my insurance got in touch with me, i spoke to an assesor and he said i live to far away for him to come and inspect the damage costs so he asked if i would send him some pictures of the damage.
Anyway car went off to be fixed at a garage 60 miles (it was driven away) and just over a week later i get my car back on a pick up truck :S
Body work looked immaculate but apparently im not aloud to drive it as the gearbox has gone.
Rang the AA and they came out and said yes your gearbox has gone and towed it to a local garage.
Now heres the problem im arguin with my insurance company (Admiral)
Either the gearbox was damaged in the crash or this bloke who driven my car 60 miles to this garage has done something to it.
Its just so strange how it drove off fine but now its completely gone.
Admiral have refused to pay out for the gearbox saying there isnt any evidence to prove this happened in the crash....
What do i do? do i have no way of winning this case?
Should i just get it fixed my self which will cost a lot of money or keep fighting??
I drive a mk4 Golf by the way

admiral should supply your car back full fixed working etc, explain to them the situation a little more and fight the case at them, they have to repair the car if they dont accept say your going to take legal action.

If not ring up the garage that repaired it and ask why they drove it to their garage and not to yours saying that the gearbox must have gone when they were driving it.

AA sometimes they have policys where they will fix the car to a certain amount of money read the small print i know the rac do this !

its been going on for 2 weeks now. ive rang them everday and keep getting the same answer.. We won't pay out as this was not stated when the car was reported damaged and there is no proof to say it happened in the crash". Apparently its a common fault with golfs but ive spoke to someone who works for wolkswagon and hes never come across this at a low mileage car like mine.

Threaten them with the ombudsmen - they'll get the quaking in their boots as they have done you wrong and have damaged? the running of your car

Ive not long had the car, i brought it from someone else in tywyn. so my guess is u've seen him in it? didnt know anyone else from gwynedd was on here lol, hav'nt been here for a while

Try speaking to the citizens advice bureau. They will be more help than guessers on here.

You sell it locally, I was up in June when I seen it.

Some plank was driving up and down the front in his silver MG thinking he was all it lolz.

u sure it wasnt a rover 200? has the mg wheels i think. with fusion stickers on it

Sureley its enough proof that you drove your car to the crash spot. It aint like you pushed your car there with a broken gearbox.
