so then yesterday afternoon i was driving down the motorway, wasn't speeding or anything and all of a sudden i hear this loud bang. so i look thru my rear view mirror and see my spare wheel flying down behind me, it smashes into this punto behind me. i thirt it would be best if i pulled over onto the hard shoulder the punto guy pulled over aswel got my wheel back from under his car, swapped all details over for insurance n that just in case theres owt wrong.
this mornin he rings me up sayin that his exhaust minifold and a few other bits are fucked, gonna cost bout £500 to fix :(
is this my fault?

oh i forgot to say that i had it m.o.t'd on christmas eve so they would o bin the last people to mess with my spare and if they didn't put it back on right could it be the m.o.t garges fault?

The garage wont give a "££^ as soon as its left the garage they can just say that you could have messed with it. :(

Where did the wheel hit his car? If he's claiming for a new exhaust, manifold etc etc did it go under his car and he drove over it doing close to 70mph?

Thats rather unlucky tbh, your not going to be able to pin it on the garage either buddy. Accidents happen though & thats why we've all got insurance

Feel for ya, thats proper bad luck.

Ditch the spare and carry a tub of the puncture stuff. Got rid of mines ages ago.

Yes it is o_O. If a spare is there, then they have to see if there is enough tread on it.

Even if there is a fat boot install over it? (for cars that dont feel the need to hang them underneath)

Tyre condition
A failure with respect to tyre wear will result where:-
The grooves of the tread pattern are not at least 1.6mm throughout a continuous band comprising:
• Central 3/4 of the breadth of tread
• Entire outer circumference of the tyre.

Tyres must be correctly matched with regard to:
• Type
• Size
• Structure
• Location on the vehicle with respect to the axles.

Also examined:
• General condition of tyre
• Condition of valve

Tyres fail if they have serious cuts, bulges or other damage. The wear on the tyre is checked with a tyre tread depth gauge to ensure compliance. The tyres are examined to ensure that there is no fouling with any part of the vehicle.

Spare fell off my old 8v a few years ago, yes you are liable as it is off your vehicle, same as the van who dropped piping and ruined my radiator.

when i bought my car this very nearly happend to me :( i took the car to the garage to be checked out as i had just bought it and the mechanic said a few more miles and it would have come off... it was hanging on by the last 3 threads of the nut

thank god i took for a check up lol

TBF though folks, we're talking about a Saxo. It's a tiny cage holding the wheel in and the MOT tester does not need to take the spare wheel out to see the tread so they probably won't have spotted it being loose.

Unlucky situation, but it is you're fault :n:

yeah it slammed under his car and he dragged it onto the hard shoulder, so it was underneath when we pulled up :( insurance is covering it just lost my 2 years no claims :(

Ive looped some nylon rope through the holes in the wheel as a backup just encase :)

was going to say would it be better to not go through insurance as to not lose your no claims? not sure what your excess is?

my car slid on the ice in to a lamp post xmas eve and bent the tack rod end and track rod and dented my wing, ruined my trim around the wheel arch while i was in the pub.

insurance would have paid out, but I would have lost 2 years no claims, and my excess was £250 so would have had to pay that anyway. so may aswell fix it myself

The spare is checkd on the mot!
They dont remove it though as they arnt allowd to. They just do a visual damage check and tread check.
Though if one isnt fitted they cant check it!
But if it is not legal they can fail it

my car failed its mot at a dealer for the wheel cage not being securely tightened.

if its not there then then dont check it obv

and ive also heard that your insurance wont cover this because its not 'attached' to the car as such also seen it on tv, yes its your fault but insurance dont pay out for it as its come from your car but its not apart of it lol

yeah already spoke with the insuarance and there covering it

i was racing my mate in his cavalier sri down some country lanes a couple of years ago. he was pretty close behind when i checked my mirrors. i was in my old vts and halfway to my house i heard a loud bang and some scraping. oh crap, sounds expensive, i thought it was my exhaust. 2 minutes later pull up outside my house and i was looking underneath and saw the cage and at the time i was bemused what it was i was looking at. me mate pulls up, opens his door and lobs a wheel at me, my spare wheel! 'you missing something?'. whoops, ever since then i have owned tyre weld and never carry a spare.

I've got a massive security bolt through mine. Goes through the wheel and into the car with a metal plate on it, stops that from happening (in theory) and also its a good theft deterant too.

106's have that. a huge bolt which you have to undo in the middle of the floor
