My girlfriends car was recently in a crash and has been written off by her insurance. She has declared it as SORN with dvla online and is waiting to get paid out for it by her ins company. She still has the v5 and tax on the car and has found a potential buyer. What does she need to do when she sells it? does she need to send the v5 to her ins company and the buyer request it back or just fill out the v5 like a normal sale? and how can the sorn be removed without having to re tax it?

Thanks

If the insurance payout unless you buy it back the car becomes there property!
So legaly you cant sell it.
They will also request you surrender the v5, though as the present keeper you can claim any full monthes tax back useing a form v14, though this should of being döne when it was declared sorn.
only way to remove a sorn is tax the car.

Basically what Swampy says.

If she does own the car to sell, then the new owner will either have to tax it or declare it as SORN again. If they don't they might get a nasty surprise when it comes to taxing it. lol.

unless the insurance company has stated otherwise, the car will become there property if they are paying out a full loss claim against it.

Theyve deducted £240 from her payout so she can sell the car herself.

She declared it as SORN online but it has tax already from before the crash. So what happens? The buyer wants to take it tomorrow..

Do i give him the green slip on V5 as normal and buyer just lets DVLA know its on road and has tax or....??????

Also must it have any tests after being fixed before going on road??

Thanks

are you sure the £240 wasnt the deduction for the excess?
if you are 100% certain that you have the right to sell the car, then do so as if selling it normally.
i presume the prospective buyer is fully aware its been classed as a write off?

what category did they class it as?

Lol! I dont need fakes but thanks. Im 110% sure, the £240 was definately salvage costs they offered £1700 minus £400 excess and £240 to keep the car because thats what they would have got to scrap it but the insurance assesor guy said she'd make alot more to sell privately which she did shes getting £650 tomorrow.

They havent told her what class but im guessing C. It was just side damage, the buyer just wants to bodge it and use it for running around so not really that arsed aslong as everything is legal.

So just give him the v5 slip as normal and reciept and everythings good?!

I know pretty pleased, means shes only lost £50 off what she paid for it. Gutted though it was a minter with excellent history just hope she can find another good one!

It was a hit and run! Bastard drove off aswell, luckily she got the reg and police are investigating it.

The fact you have declared it sorn means it no longer has valid tax on it!
She should of claimed the tax back at the time she declared it sorn
so she may not be able to reclaim it.
If you still have the log book then id say its a cat d and as such wont require a vic test
