Hi,
I recently sold some Bose speakers on ebay, they were working perfectly fine when I sent them..
I have recieved an email from the guy I sold them to saying there is a loose connection and the sound cuts out or there is feedback.
He has opened an "ebay case" and wants a refund. What happens if I don't give him the refund? Because as far as I am concerned, he has broken them.

This is why i no longer sell on ebay.....too many scamming morons about!!!
I would be asking for the item to be returned......

I know what you mean buddy but most of the time the retards at paypal will issue a refund.....then you have no speakers and no money....:n:

paypal wont refund until the item has been returned and he will need to prove return aswell, dont refund without having goods back stick it out see what happens he may just be bluffing trying his luck

Or, he has some broken speakers and is trying to swap them for yours, for free...

i had same issue but with a surround sound set. Was working perfectly fine when i sent it, all bubble wrapped, so safely packed. He claimed they didn't work, opened paypal dispute, and ended up getting refunded and keeping the surround sound. Scandolous in my opinion, but to return it would have cost £20 ish? and he wanted me to pay for that too, and if it was supposedly "broken" there was no need for me t have it back.

If hes saying theyre broke when they aint and if he got them for a cheap price he probabaly wont want to give them back for a refund.
If he got them for a normal price that he can buy another set for then he probs wont mind a refund but if he has to return them aswell then he might MAKE a loose connection. So youll have no money from a refund and then a set of broken speakers.

Go ahead and let them open a case and fight your side, if they were good when you sent them you shouldn't have anything t worry about.

Paypal wont look at it like that. Even if they were brand new in a box and he sold them as second hand, paypal will go in favour of the buyer. The OPer will definatly lose his case.

So how will the refund be given? Will paypal take money straight out of my bank account without me having a choice about it?

this hapend to me before and i just ignored the emails and it soon went away, paypal cant just take the money off you and the only thing the buyer can do is take you to a small claims sourt which probably wont happen

If he wins his case and paypal issue a refund, if you have no funds in your paypal it goes to -neg funds. If you have no funds in your bank and paypal trys to take the money out your bank then itll take your bank to -neg or if you dont have an organised overdraft or anything then possibly a fine.

They can they do it to everyone lol. Why do you think everyone hates them so much lol thats the main reason.

if you read the paypal terms and conditions you sign up to - they basically have open reign of your bank account

IF paypal decide that the buyer is right (which they always do) then you dont have a choice but to refund.
Contact the buyer now and ask him to send them back and youll refund the money. If you leave it too late paypal will take the money back and you wont have a leg to stand on with gettin the speakers back.

on my paypal account, it says I have no open cases with them.. is the "paypal dispute" and "ebay case" two different things?

When I log in to Paypal, under "My Account" - "Resolution Centre" and the "View Open Cases" it says "- You don't have any open cases -"
When I log into Ebay just below the summery of the advert it says "eBay note: Your action is required on the not as described case" if I click that it says I have untill April 14th to respond.. I can "respond" by getting the speakers back and a full refund, just give a full refund, issue a part refund or offer another solution (sending missing parts etc..)

this has happened to me before, message the person and offer a refund if they send the speakers back, but dont refund till you get them back, if they say no, they are trying to con you really, because if they are a genuine buyer they shouldnt have a problem sending them back if there genuinely is a problem. also ebay and paypal both view the correspondence between you and the buyer in their cases so just bee nice to them other wise paypal will just see the buyer as the victim, at least offering a refund, they might cancel the dispute meaning you have time to prepare for the funds coming out of your account instead of paypal pinching it =]

If he starts a paypal dispute (different to an ebay return request) its loosey linked with ebay. He will need to provide proof of postage of the return and as long as he does that he is guaranteed to get his money back. Even if he posts you a brick!
If the money isn't in your account he wont get it back but your account will go into negative balance and you cannot receive payments until its sorted by transferring money out of your bank. You wont be able to start up another paypal account either. If you do it will get deleted after a few days.

From my past experience (last year in case things have changed since then). I had paypal linked as a direct debit to my bank account and it tried to withdraw from one of my accounts. Was one i rarley use so had no funds. Becouse i had a direct debit try and debit my account which had in sufficient funds, halifax then fined me £40 for this. I know halifax have changed now so you get a different fine or charge per day on negative balance.
As for within a negative balance in paypal, i was still able to sell on ebay and i cleared my negative with paypal payments from stuff i sold on eBay.
Like i say i dont know if things have changed since then though.
This was over a deck (vinyl turntable). It was a paypal dispute and i even took a pic of the recipt from sending it at the post office and uploaded it. The dispute was item not recived btw. Regardless of the proof i provided paypal still decided i hadnt sent it and refunded the buyer leaving me in negative and then it tried to withdraw from my account as i had a direct debit set up.

Ahh if youve got a direct debit then they might. I avoid stuff like that whenever i can as i know the banks love to dish out fines lol.
Same thing happend to me though, i scanned in a pic of the proof of postage and cause it wasnt tracked they dont count it as genuine. Bye bye £90 dastek :(

i sold my old motorbike on ebay and the buyer said it wasn't as described and opened a case, so instead of getting fined etc. i just sent him £200 back just to avoid the hassle. but at the end of the day, who buys any car/motorbike without ever coming to look at it? that pissed me off lol

wait till you get a divvy who buys a 38 year old Beetle off you on ebay without looking at it and then moans about every mark even though as with all cars we sell, we state "VIEWING STRONGLY RECOMMENDED!!", sent a driver to collect (to Nottingham from Edinburgh) and then left me neg feedback as it wasn't the origanal engine

i've had this happen loads of times, ask them to return the "faulty" part and mention that all items are security marked prior to despatch and usually it all go's quiet,
I agree had loads of people try it on when you ask for return of item then you will refund all goes quiet and i have even had someone claim they didnt get an item when i had proof of receipt and all eventually led to me getting positive feedback
Defiantely do not give a refund until goods have been returned

Should add under paypal rules the person sending goods back is responsible for postage costs of return

Ebay/PayPal are Fing useless.
I have had one buyer win a helmet that under “condition” I listed as “new” As it was as new, never used and still in original packaging. They buyer companied that it was “not this years helmet” even though I did list the exact model in the listing. So I refused to refund the postage if he was to return as it was him who bid on the wrong helmet. He opened a PayPal dispute and won. PayPal took all the money off me and gave it back to him upon him proving he had returned the helmet to me. But the real boot up the ass was he had vandalised the helmet. I complained to PayPal but they would not have any of it.
Another one was a item that was lost in the post. ( I actually had 3 items that apparently got lost ) I sent it first class recorded delivery so had a tracking number. They guy complained that it did not arrive. I said I would fill in a lost item form with the post office and as soon as they let me know what happened to the item ie lost, damaged delayed I would give a full refund including postage costs if it was lost or damaged. The guy open a PayPal depute and every day I was getting abuse from the guy. PayPal refunded him but it turned out the item was only delayed in the xmas post. So the buyer had the money and the item. Again I companied to PayPal but again they would not have any of it.
I have a few more such run ins with PayPal and all I can say is they are useless.
