I put a deposit down on a bike awhile back with a garage (not a private sale), now whenever I ring the garage a really nice bloke answers, but he's the mechanic and cannot refund my money, and they guy who can is never in (or so they say), its been 4 months and they owe me £100, I just wondered what legal advice I could take. I need that money for my car im buying shortly! :y:

go down and wait till owner arrives or arrange a meet when he can be thair.. legal advice well they,ll just say send a solicitors letter and go to small claims were as you will probs end up with nothing...

Non sensible answer.....Go down there, take their computer/tool chest and walk out saying they can have it back once they refund your money. A friend did that and they paid him on the spot.

Sensible answer. If the deposit was refundable then you can get it back, if not then you'll have to fight them in small claims.

Personally I'd go down there and wait till the owner arrives, if the owner doesn't arrive after say 4 hours say you will be seeking legal advice.

It's been 4 months. I would give them 4 minutes. Last time I had a problem with a garage, I have been very patient until I ran out of patience. And then I told them I would give them a choice: either they sort me out, either I go to the citizens advice garage, or the trading standards garage. Needless to say, I got sorted very quickly indeed.

It was a deposit.. pretty sure you can't get it back ?

Unless like said above they said it was a refunable deposit

I have proof that the funds were sent over there was £100 that left my account.
The garage promised me a bike, which then they forgot to put oil in and broke the engine, so they claimed they'd send my refund back straight away.
4 months later, 10 - 20 phone calls.
Royally pissed off

If it was their fault that the sale fell through then I'm fairly certain you're entitled to your deposit back.

Ring up, ask for the manager, if they say he's not there, ask for an alternative contact number (eg, mobile no.), then if still no luck, tell them if you haven't received the refund within 7 days you'll be taking legal action.

If no response, start a small claims action.

I'd write to them (formal text) informing them that you are willing to seek legal advise and take them to the small claims court should you not recieve your deposit in x amount of days.

Send the letter recorded.

If you don't have your refund (which is very likely) then you need to start seeking professional legal advise.

Remember to be polite in the letter and don't make it sound like a 'threat'.
