View Full Version : Quit job mid month, didn't work notice - do I get paid what I'm owed..?

Sup fellas, quick question incase anyone can clear this up for me!

I used to work part-time at comet, on a 10 hour contract.. I left mid-monthish and pay date is on 25th, I gave in my notice and had to work a weeks notice but couldn't due to commitments to new job.. They wern't happy as you can probably imagine.

Do they have a legal right to pay me for what I've already worked regardless of how I left and whether or not it ended on 'bad' terms (i.e. they were pissed at me!) As when I told him I couldn't work my notice he said "okay well you won't be paid", I don't know if he was referring to the hours I was meant to be working or what they owe me, and I don't particuarly fancy phoning up and speaking to them to ask unless I have to.

if you've worked the hours you get paid for the hours. i wouldn't like to ask a reference from them though as they will most likely refuse to give one making it look bad

edit: i will check with my mum later as she is the manager of a shop so i will ask for you mate

Is that for sure? Yeah he said "let's hope <new employer> doesn't ask for a reference".. Well thankfully I know the person who got me the job so they wern't bothered about a reference!!

I work for Comet too. My manager, on several occasions when people have done this just hasnt bothered putting their hours through to Payroll. He then waits for the phone call, and says he'll sort it, then conveniently forgets! Not nice, specially when you've worked those hours, but he says "What they gonna do? Nowt..."

Specially easy at the mo, for my manager, as he is under a lot of pressure to cut his wages budget. And he knows he won't get that much hassle about it.

Shite employer IMO, work for Tesco Tech Support team now and its soo much better! No pressure on sales etc and wage for me is basically the same. Got along with all the people there but got sick of the job, I was a sales assisstant/person however you want to look at it.

Okay well I'll wait and see, if they don't pay me and they're legally meant to I'll go in there and kick up a fuss, need the money really.

you have to keep on, can you talk directly with his boss or HR?

Hmmmmmm couldnt the old employer get out of paying you the money as you did not follow the terms and conditions with regards to 'working notice' stated in your contract???

Im not sure as i have never been employed but would be interested to know.

Well his boss is regional manager so don't know how I'd contact him (think so anyway.) Don't believe they have a HR department anymore? I recall them getting rid of it due to lack of finance to maintain it or something!!

They are legally obliged to pay for hours worked.

I've just had the same thing very recently and if they don't pay up it's amazingly how fast they will if you send a letter from your solicitor.

Don't have a solicitor! I'll just go in there and make a massive fuss / cost them alot more in money than they owe me haha.

If they refuse to pay you for the hours you had worked before you left go in and say you will be taking them to court, also put it in writing that you expect payment within like 30 days.

My friend had this probelm. Was told he wasnt getting paid for the work he had done.

He just went in and picked up a computer and stuff and said he wasnt leaving or giving them the stuff back till he got his money.

ur legally entitled to hours uve worked, the only things i think they can take away are things like holiday hours and stuff like that..

Im a store manager, and they have to pay you what you have worked regardless, i would imagine their payroll system would be similar to mine, therefor in any one week the manager cannot just not put your hours through, it would have to be put through as either u working or absent, but if they pu you through as absent then they are falsifying the system which can be gross misconduct on his part!
As for your reference, i doubt very much (90%) sure that the fact you havnt worked ur notice would come up in the reference from Comet, retail companies tend to only refer to your attendance and such like in a reference and this comes from Head Office and not from the line manager, again i would imagine it would be the same for Comet! What they can do is not pay you for any remaining holiday for the tax year!!
