View Full Version : Ok, so i nearly crashed today.

I was pulling out of a junction,and there was a shop on my right, quite close to the road, there was cars parked outside the shop, half on road, half on kurb. To my left there was a normal flowing road with cars, no cars parked on the road. So, as i intended to turn right, put my indicator on and waited there for about 10 seconds (as it was clear) deciding when i should go, as i clearly could not see to my right. So it was clear (from what i could see) and pulled out very very slowly (bowt 1-2mph) and edged out, i got to about 3 quaters of the length of the car when i could see to my right. By that time a 4x4 was oncoming around the 30/35mph mark, and only saw me at the last minute. (The speed limit was 30) She slammed her brakes on (an emergency stop) and was no futher than an inch away from my gorgeous saxo. Is this case, assuming shes hit me, who's fault is it?
Who is to blame?
Who's insurance pays out?
If you cant understand what happened ill try and draw a diagram.

You pulled out of a concealed junction?

If you can prove she was speeding. 50/50.


If you can't prove she was speeding, your fault.





But seriously, If you pull out of a concealed junction you should be giving it some. Not edging out slowly.

It doesn't matter if you can see or not. You pulled out in front of her.

It's her right of way.

It would be classed as your fault if she had hit you.

Although she could be done for careless driving/driving without due care and attention if she didnt see you till the last second.

Well. 1) I wouldn't have been creeping out of a blind junction. It would have been foot down.

and if they had hit me, then it'd be my fault.

If you pull out on somebody it is your fault. End of story. Whether they are speeding or not.

Luckily, if you can prove they were speeding (Damn near impossible) then you'll get away with 50/50

Yeah obviously your fault. Also creeping out to see what's coming is understandable, but if you were still at a creeping speed whilst crossing the road, that's obviously dangerous.. If you didn't feel you could safely turn right, then why didn't you turn left where it was safer and then turn around somewhere appropriate. Saves any risk of getting your car smashed into!

By the sounds of it whether you were creeping or not you needed to get out of the road asap- you have a vtr- give it some and get it over and done with! You have to presume everyone is speeding if you can't see because we know alot of people speed...
