My drivers side back wheel is catching on the arch when i have passagers in the back. I notice yesterday that the wheel isnt straight it goes in a bit. Dont know if this is anything to do with it.

Any one know how i can solve this please or what it could be!!!

Is the top of the wheel going in? (negative camber) If so then the rear beam is fucked. unlucky

Yes the wheel is going in only by a few inches.

I do have 195/45/15 wheels and is is lowered.

If its rubbing on the inside, and the wheels got camber, then as said its new beam.

IM axles on here do it-not sure how much

mine was rubbing, but all i needed was a 5mm spacer, because i got fat 16s on it, no rubbing now

Is it ok to drive my car if i need a new axle?

Well it won't pass an MOT with it because they will pick up on the rear trailing arm bearing or whatever you call it.

People do drive with knackered axles because many 106s/saxos have this problem. Its not "unsafe" if its in its early stages but if they have a lot of camber, then get it done ASAP.
