View Full Version : A little help needed about a fine

Hey guys
On saturday driving back home from Paignton I was following another car along the dual carriageway thought I was doing 85 tops
Just as I slowed down, cop pulls me over. :panic:
Basically they told me to expect a court summons through the post etc.
Readers please don't bother replying saying I deserve it etc, I know I fucked up and I do deserve a fine etc, but I do have a question:
Does anyone know what the police procedure is for if they stop you?
The reason I ask is that when they pulled me over, they didn't ask me to get in the back of their patrol car, never shown me any evidence, didn't give me any documentation or a statement even though they had cautioned me, and this seems very confusing as before when i've been stopped for having a faulty brake light I was given a producer to take all my documents up to the police station.
Can anyone shed some light on this?? Were they just trying to scare me?

most of time if they seen u doing 100mph bye bye licence.

not the same but bf got caught on the phone and they gave him a piece of paper to go police station and pay the fine and give his license in.
if its going to court and they didnt have a camera oboard id imagine they cant do much as theyres no evidence?

i think they have to take down ur details and you will normally be given a yellow slip as record that you have been caught

my mate got caught doing 97mph, got 3 points and £60 fine, copper said if he got caught doing a tonne it would be an instant ban.
but they didnt give you a slip or anything im not sure, unless your instantly just sent to court, i dont know how the police do things nowadays.
were they with you for long?

The 2 officers said they'd "been following me for some time and recorded 102mph" but I have absolutely no paperwork or slips to say they stopped me, they took my address details etc down, but no evidence shown, and 1 of the officers even said that because I have a clean licence and only ever had 1 minor speeding fine which was over 7 years ago that the judge would "probably just give me a big fine instead of banning me completely"
I honestly think that the officers were doing a less than half assed job at the moment, and I can't help but think that IF I do actually recieve anything through the post about going to court, I'm thinking about challenging it completely due to the fact I don't think there is any evidence, as surely they would have shown me it if they had it???

dont challenge it unless you want to get fucked over for it you know you were in the wrong mate and to be honest instead of challenging it just deny it and see if they have any evidence

Friend was stopped on the M1 last year with an average of 99mph over 3 miles. Got 6 points and a £250 fine (fine depends on your financial situation though). If you were clocked over 100 then you will get a ban, the length depends on how much of an example they want to make of you on the day.

yeh he has but the police might not find it i think it is that if ur caught doing over 100 then its an instant ban but why not take the risk and deny it to see what happens might let you keep ur license

I dont think they would take you to court without any evidence. That wouldn't go down very well with a judge now would it..
Court cases are not cheap so at a guess I would say they are sure to get a conviction out of it..

what evidence do they need really, end of the day they are coppers its their word against yours.
they could have had the video evidence but had no need to show u as u might not have denied it on scene.

If it goes to court it's the prosecutions job to prove you guilty, not for you to prove your innocence. If they have firm evidence (which you can view prior to the court date) then you are screwed. Half the time though they don't have enough to prosecute, so I would always challenge

Nw was it a traffic car that pulled you?
If not - Normal police cars dont all have speed cameras attached to them?
They only thing they can possibly do you for is "dangerous driving"
Bit thats only if you were weaving in and out of traffic!!!

For a speeding fine:They need evidence to prove your exact speed!

wrong. Traffic offences are not criminal, which means you can be "reported" and/or "summoned"

Again not true. They can "report" you for any number of offences, and if they gather enough evidence vy way of witness statements can have you bumed over in no time.

As above they can report you for any number of offences from eating an apple (driving without due care and attention or careless driving) to being distracted by your kids in the back seat.
Best thing to do is wait to see if you receive a summons, and if you do speak to a solicitor.
No point having half of saxp speculate without actually having a clue

They did caution me etc, yet I have no documents from them to back this up, and no statement taken etc.
I think it was a normal cop car (a ford focus) Just need to wait and see what happens I guess for the moment

If I were you mate I would wait for documentation to come through the post for a court summons. If that turns up get a solicitor involved, ask to see video evidence. If you do wish to fight it then the fact they didnt give you any documents at the road side might help a little.
Pretty sure they need to give you some form of paperwork to say you have been caught, even if they are taking you to court rather than just 3 points £60 fine. Might be wrok but thats what I would of thought they need to do.
