View Full Version : Phones4U Contract - Can I change my handset, less than 14 days?

On the 8th of this month I renewed my contract though Phones4U and got a HTC Sensation on a 24 month contract at £32 a month, handset free. At first it was fine but now the touch screen is playing up, when trying to text itll add in random letters or if you press A for example it'll show an A then suddenly come a Z etc. I googled about and it seems quite a few people are having problems with the touch screen on the phone, you can get a Samsung Galaxy S2 for the same price, same minutes etc etc, does anyone know if there's anyway I can go about getting my handset swapped or one of these instead, keeping the contract etc?
Has anyone had any experience like this before? Don't really want to keep the phone given that it's having problems in less than 2 weeks, and it's got 2 last 2 years! The samsungs seem to be getting better feedback..
At work atm but will try give them a call later on if they're open but just wanted to get some feedback based on any first hand experience anyone may have, or any law/legislation I can use to back my case up.

yeah you have 14 to change the phone if its not what you want or you cant get used to it

Really does that apply instore? As I know if you buy online you're covered by some long distance selling regulation, but I took mine out instore.

If you bought it "mail order" you get a 14-28 day cooling off period but not sure if this extends to upgrades as opposed to new sales.
Google the distance selling act and see what comes up

i bought a phone instore and couldn't get used to it so went back after a week and got something else

Went into phones4u on my lunch, they factory reset it and said I had to try that first, then if that doesn't work they'll swapit for another Sensation I think, but said I can't swap it for a different handset?! Any ideas?

Contract phones ftw! works out way cheaper, unless you use your phone like once a week for the odd call lol

Buying in store and distance buying (ie mail order or online) have different rules about returning unwanted items or items that are faulty or those with service agreements.

Pay as You go used to be for the poor, but now it's not so bad, vodaphone do a £20 P&G sim with 3000 texts and 600 mins...

Factory reset and it's alright now, I just fancy a diff phone tbh. Get bored quick.

I looked on the Consumer Act website and it seems it's not actually a legal requirement? I also spoke to Phones4U live help and they said this was the case when I asked if I could cancel the contract.

It might not be a legally binding get out clause, but most companies if pushed hard enough will abide by the "rules" set out in the consumer acts etc
They are just guides that the companies hopefully will follow, otherwise Trading Standards (who have no balls) would seek to make it law.
