Few months ago my brother went out with his mates clubbing, he was driving and was parked up down a road near the club. Anyways as the night went on he decided to get drink and stay the night. Anyways to cut a long story short the bird he pulled binned him off leaving him with nowhere to stay. So he went back to his car go in put the seat back and went to sleep. Few hour later he was awoken by a tap on his window. It was the police so he sat up opened his window and the officer asked him to move his car as the police needed to clear a couple of car spaces to make way for an ambulance that was on its way to help someone, but my brother said I can't move it I've been drinking that's why I was sleeping in my car with that they arrested him and did him for drink driving and he refused a breath test as he was only sleeping when the knocked his window not driving. Back at the station they got a reading of 3 and half times over the limit and he went to court today, he pledged his case and got the charge downgraded to "drunk in control of motor vehicle" 10 points and £200 fine... Lucky boy considering, he never knew u couldnt sleep I. Your car even if it's parked up

My dad told me he got done for same thing years ago, he went out on his motorbike when he was my age (20) and had a few drinks so he pushed it home, police obvs though he nicked it so stopped him he explained he been drinking so he was pushing it home but they nicked him for being in control while drunk got a 6 points and £400 fine! Bastards.

Makes you think, ive slept in mine before whilst drunk.

What if your mate gave you the keys to their car and you crashed out drunk in the back.....what if you didn't have a driving licence....what would they do then?

I think if you dont have the keys to the vehicle but can prove it yours then you should be ok. But I guess drunk and IN control is better than drunk and wildly out of control....

If you're in the back and your keys are in the glove box its pretty clear you aren't intending to drive it. You should have done a breath test anyway just to gloat about how wasted you got.

If the keys were in the boot, would of been a different story.

Same as a motorcycle. You're not allowed to push a motorcycle on a public road without wearing a helmet. It's cos you're in control of it.

Stupid if you ask me, especially considering your mate made the decision NOT to drive and to sleep it off.

Well i'd say it would be a different story if they were in your glove box i know that they were being c*nts and charging him for something like that but how is he to prove that he hadnt driven it there and parked up then fallen asleep unless there was cctv. His word against theirs really.

Apparently they cant do you for this. Disconnect the battery and put the keys in the boot. I read it on a forum ages ago.

Another idea is maybe take one of the wheels off and put it in the boot and leave it on the jack all night :fcuk:

my mate got done for drunk in charge of a motor vehicle for sitting on a 50cc monkey bike in his garden

we were having a drink and the bikes were in the passage, his mother wanted to bring the shopping in so we pulled them out, he got done for sitting on it in the garden because the keys were on it also

i also nearly go done for this...was weaving in/out of the white lines with no hands on bars... drinking a can on way home from a mates years ago, iirc i was about 15... i laughed at him and he arrested me :/

let me go with a warning though :homme:

i was utterly gobsmacked...he told me if there was a van available in the area to colect my bike he would of had me aswell :fcuk:

obviously none of you guys live in the countryside! the cops dont mind if we sleep in our cars, the cops actually advise us to cycle when drunk rather than trying to walk along the backroads etc etc

You cannot get endorsements on your UK driving licence for a ‘drink cycling’ offence. Some US States have such a law so be careful when searching on this topic via Google.

My brothers gutted about the whole thing but nothing he can do and least he can keep his license even tho it had 10 smackers on it and just to clear up he was sleeping in the front with seat reclined.

How fucked up is this then, i read on another forum that a bloke went out with his wife one night, in a taxi got pissed at a party got a taxi home but before they got in the house they started having a domestic in the front garden, she went in the house but wouldn't let him in. Mean while there neighbours had heard enough arguing so called the police. The bloke who couldn't get into his house coz his wife locked him out decided to sleep in his car that was on the drive way, so got in and snoozed off. Next thing thepice wake him up say they had a complaint of a domestic but soon as he went to speak gets addressed with the words "you been drinking tonight, I want to do a breath test on you" he explains he hasn't been driving and only slept in the car and he also goes on to tell them to try start the car coz the engines out (his mk1 escort he's rebuilding) and that the car can't physically move or start but they cart him off and he got done anyway as couldn't prove in court that the car had no engine in at the time they did him even tho they didn't look like he asked them to before carting him off. PISSED ent the word getting nicked for drink driving a car with no engine lol

iv slept in my car loads when i have been fucked, i do not like leaving it ANYWHERE that i am not in the immediate vicinity of.

also spent a full weeked in it at a festival in july because it was warmer than the tent.

My friend got done for this - slept in the back of his car in a Tesco underground car park - he got away with it as he was on CCTV just getting straight in the back.

You can also get done for being drunk and in control of a horse too.....

It's a really shit situation, it's the same as in a camper van. Technically if you drink in a camper van they can fuck you over.

I've slept in my car pissed many times & it's risky, it's so stupid but he may of been better to actually move the car and risk it but then if he had done that they genuinely could of fucked him over, it also begs the question why would a sober guy sleep in a bloody car!?

tbh - I think its highly unlikley that they would actually do you for it! we ride to the pub in the summer to - have a pub lunch in the gardens and a few drinks and ride home. normally we ride across the pentland hills so you don't hit any 'roads' so we get pretty pissed tbh.

It works exactly the same for a camper-van driver. When I looked into this I was advised by other camper-van drivers to have a lockable box outside your van where you store your keys while under the influence. It's definitely not wise to do this on a public road, although I've been there and done that myself years ago.

Now even on green lanes, at festivals or private campsites if I'm having a beer I store my keys away in a magnetic box which normally just holds a spare key, and manual alarm and immobiliser instructions, this then sits in part of the chasis under the truck.

Camper-van drivers can get done for exactly the same thing.

Yep, this guy came into the pub I was DJing in the day he was arrested and told us about it, we didn't believe him until we saw the story in the paper a little while later....

this came up a while back on another forum, someone did the same but left their keys with a mate so they wouldn't be able to start the car. Then went to sleep in the back - the guy was woken up by the police and still got arrested though because he was 'in the car' while being drunk... i'm not saying i agree or anything but someone on the forum mentioned that even without the keys he still could've taken the handbreak off and rolled the car down the street or something,

while i dont agree with it and OPs brother should really have been let off, i see the point in the law

You can get done for drink driving even being around your car with the keys in you pocket whilst pissed, so if you've driven somewhere had a few drinks and realise you've left something you need in your car just be careful

Driving under the influence of alcohol would require you to be actual driving I would imagine.

Thought this was only the case if the bikes engine was running? As I know a kid who did it with his moped as he was going up a hill so had turned it on to make it easier. The officer said if you were just pushing it with the engine off you would have been fine...
