View Full Version : Bought a new motor and.....
manta

A week or so ago I bought a red R from a dealer.
Had the arch liners off today to clean the arches off etc and both inner arches have rotted through, like badly.
Do I have a leg to stand on if I go back to the dealer?

Wouldn't pass an MOT with bad rot on structural parts of the car

from the trading standards website
"When you buy goods from a trader, you enter into a legally binding contract governed by the Sale of Goods Act 1979, as amended by the Sale and Supply of Goods Act 1994 and the Sale and Supply of Goods to Consumers Regulations 2002.
If you buy a used car from a trader it must be of satisfactory quality, fit for the purpose, and as described. Obviously a very old car with a high mileage will not be as good as a newer car with a low mileage, but it should still be fit for use on the road, in a condition which reflects its age and price, and reliable.
Traders cannot take away consumer's rights by using terms such as ‘sold as seen’.
Your legal rights are reduced if you buy a car from a private seller or an auction. If you buy a used car via the internet, you may have additional rights under the Distance Selling Regulations."

further, you may wish to cite the consumer transactions (restrictions on statements) order 1976. This makes it an offence to display or publish anything which suggest that consumers rights are affected in any way.

The law states that nothing can be 'sold as seen'. As a consumer you do have rights, even when buying second hand goods.
Go back to the dealer and calmly explain the situation. If he is a bellend then just call trading standards and go from there.
I would look at the MOT and also go back to the garage, if the rust is that bad then it should have been an advisory on the last MOT.

I've rang the dude and obviously he's not as friendly as he was a week ago when I picked the car.
He wants me to take the car down tomorrow and he's going to put it on the lift or some shit. And then he's like you should get it inspected by an independent person blah blah from the DVLA or something, and then something about contacting trading standards. He just went on about he's got all the books on it etc and he's got friends in trading standards so he knows it all.
TBH think I'll just call trading standards on monday, if anyone has anymore advice that would be helpful.
Thanks for all the help/advice you've given so far (except captain steroids).

Same sort of thing happened to me on my last car
They said it was fine just serviced with fsh,
which when looking properly it was there garage stamp and handwritten mileage on 2 pages when the previous owner lived 350 miles from the garage,
I went down there they told me there is nothing wrong with it as it was driven to Wales and back last week (yes that was how they know it was fine)
Kicked up a stink and the owner and his 2 sons came out and threatened to kill me if I came back,
Called trading standards they said I have to go back there again and write a letter to them giving them atleast 6 weeks to reply before sending another one and do that about 3/4 times and them trading standards would get involved
I decided it wasn't worth all the hassle and left it
About a fortnight ago me and about 9/10 (3of which had also been done over by this guy) others went down there and trashed all his cars/workshop as payment for the £2500 they had off me and the £1600 I had to spend repairing this "immaculate car"
Moral of the story go down there be polite and try and get it sorted if not then go to trading standards

Surely the moral of this story is that trading standard do not intervene quickly enough so the best thing is to 'trash' the guys workshop to make yourself feel better??
You achieved nothing except to make yourself feel better, you didn't get the money back and you still have a fucked car......and the dealer likely had insurance anyway.
Why did you not follow trading standards advice? Did you think they were going to storm in there guns blazing and shut him down straight away?

I took it alot better than my friends did one had bought a car that had something called a logbook loan on it and he had the car repossessed and lost over 5k but he didn't contact trading standards regarding that

I do understand it wasnt a great idea but it made us all feel a bit better but I just though it would have been a bit quicker than what had proposed and it just seemed like they didn't actually care

exactly this. I think it is safe to assume that "rotten arches" wasn't in the description.

Err excuse me? You couldn't be arsed to write 3 or 4 letters for the sake of getting £4100 back? Two wrongs don't make a right, and in your case: you're a lazy bastard and a thug. The best part is, you could have tradingstandardized his ass big time and could have made extra money out of it.

should of just done what trading standards said..
my mate got a mini for a garage and within 2 weeks it needed a whole lot of work doing costing more than 2k, got trading standards involved and they got him the money back for what it cost to repair.

Thing is, is it reasonable to expect a car dealer to remove the trim to check the arches underneath, or is it blindingly obvious to see without removing bits? Is rust on the arches technically classed as structural?
Depends on how the car was advertised I guess, and how much you paid for it as well. If you only gave say £600, I'm sure that gets taken in to account as you wouldn't expect a mint saxo for £600, and they are prone to rust etc.
