Was having a discussion with my mates...
One of them has a left hand drive car, Say if you go out for a drive with a passenger and his spare steering wheel, and do the classic 'passenger pretends to be steering'

If you distract someone on the road and cause them to crash, Will it be your fault? Or is it the other drivers responsibility to control his vehicle?

I hate the thought of how you can be distracted and make a mistake because of it and it's their fault for distracting you? Wtf. It's the one who crashed fault no matter what.

I would have thought it would be the passengers fault, if that happened to me and it was my passenger that caused the accident I wouldn't feel I personally caused it. But god knows who would be guilty in court I would imagine the driver may be vicariously liable and I study degree level law haha!

If you crash because you were looking at a girl in a short skirt you're not gonna blame the girl are you.

Their fault for crashing imo.

I'd say it could potentially set a precedent...

As much as you should be paying attention to the road, you shouldn't be overly distracted by people doing things in order to distract or attract attention without good cause.

Personally, if I was the Judge, I'd be giving the telling off to the passenger, can't have people going around distracting other drivers knowing they will get away with it.

On one I those police programs there were some kids waving at cars on a motorway footbridge and the police told them not to wave after a clio crashed. Can't blame the kids though only time it matters is if they're throwing things? Thats different obviously.

I wouldn't see the big fasination though. Foreign drivers drive on the roads, nobody seems to even notice.

Only time I notice a left hand drive car is if there's a little kid in the passenger seat. Shits me right up at first!

Similar to this is the guy who put a fake speed camera in his garden. His village is on a major road and cars speed through at 60. Hes been told if he doesnt remove it and someone says they were distracted by it resulting in a crash he can be sued.

I personally think its the other persons fault, unless the passenger was dilberately trying to distract them. Cant see the issue with having the spare wheel in the passengers hands though. Other drivers should be concentrating on the road at the end of the day.

However the passenger would probably be taken to court over it, if an accident happened.

before some of you guys start jumping to conclusions... no i havent done this/or am intending to distract other drivers into crashing.
Although my mate does have a left hand drive car, and i do have a spare wheel, and it is hilarious seeing peoples reactions in traffic when you 'pull off' the steering wheel :p

Lol at all the comments, if the driver was distracted by another driver their not paying full attention to the road.

becuase ive done it standing in traffic when i just so happened to have my spare wheel when he took me to buy it. I haven't done what was done in that youtube link/havent made anyone crash etc as its done in traffic.

OP needs to get out more if he finds that funny

I think you need to get some friends and have a laugh tbh do you have a sense of humour?

I think you could possibly get something done? A driver being distracted and crashing is pretty much there fault but if your intentionally distracting a driver (which is how they would see it i guess) then maybe they could do something?

I really dont see what they could do though, your not the driver so its not a driving offence and you didnt cause the damage first hand so its not like criminal damage :s

Do it and let them catch you im intrested to see what happens haha.

its an interesting argument though tbf would like to see what happens. Becuase then you could say, would the person distracting, even have to stop? are they running away from the scene if they dont stop?

Fair enough. Ive pretended to hold a wheel, we didnt have one in my mates car. Only in stopped traffic though like you.

Lol at e30, sound a bit tense. Never had a discussion on the consequences of doing something etc with your mates?
