Over the weekend one of my mates got pulled over at around 11pm and was found over the limit... She blew a 55 when back at the police station which is 20 over the limit...
She is due in court next monday, and wants me to go with her as she is shitting herself!
I'm seeing her later to have a catch up and just want to put her at ease, does anybody have any idea of what fine/points she will get?
She is pleading guilty and doesn't have a solicitor so we are going to try n make some sort of plea statement for her to follow... Any idea on what the right and wrong things to say are?
She doesn't earn a great deal, and has no previous driving convictions etc so that will be mentioned amongst other things!
Any input will be appreciated!!

She will get a 12 month ban minimum, drink driving is automatically 12 months. Probably some points and maybe a fine.
In the past if you agreed to a drink driving awareness course for a fee around £100 they would reduce your ban by 30% so if she's banned for 12months she will get 9months by doing the course..

Drunk drivers should be permanently banned from road use. You can argue it all you want, but its so easy to not notice someone when you are driving normally; but when you're not thinking straight then it makes it so much easier to instantly kill someone. Rant over.

I'm against drink driving don't get me wrong theres no excuse but please keep on topic as 'fuck her' etc isn't really helpful though valid from certain peoples perspectives!
She's already having a hard time from her family about it, it was a daft mistake fortunately there was no accident etc and nobody hurt but she will pay the price for her actions
she had a glass of wine whilst watching the football, and when she got dropped off home realised she was locked out with no battery left on her phone! .. And therefore drove somewhere she knew she could stay for the night

a glass? Lol, considering what she blew that must have been a pint. A glass of wine over a period of 90 minutes shouldn't come up as a 55. I always check for my keys, wallet and phone before I leave my house, and also before I leave from anywhere else. Simple habit.
Back on topic: ban, fine, drink drive course, community service, insurance price hike.

tbh she'll probably just get a ban, some points and a fine. imo they should cut up her licence. you try seeing a good mate knocked off his motorbike and killed in front of you by somone so drunk they werent sober until a day and a half later and then tried denying it while still in the cell. zero tolerance ftw.

No matter what, its a 12 month ban, no ifs, no buts.. Shouldnt be made to do a test again, will just have to send off to get her license back at the end of the 12 months, and prepare to be raped, or not even touched by most insurance companys!
If you are insisting on writing a letter, get a few character references from reputable people, this will help no end, doing that is what drew the line with me getting a suspended sentence, and not prison.. People like business owners and that kind of thing.. Saying its not the kind of thing she would do.. With headed paper, or contact details, plus stating who they are, and what they do, and the relationship with her.. Obviously not family..
Next, if she is writing a letter, let them know how remorseful she is, how it was the biggest mistake she has made, and it was under exceptional circumstances, and how she wishes she could have used better judgement to not have done it.. Also how shaken she is, to have broken the law unknowingly, as its a 1st offence of any kind..

She made decisions that she thought was the best route. Why wasnt her door key attached to her car key like 99% of us? Why didn't she sleep in her car for a few hours?
This story obviously has a flaw, the women was clearly drunk. A 55 is not a glass and she is lying to you saying it is.

Not only will she get banned, try getting an insurance quote after being convicted. I heard it's a good 5 grand more.

Yeh well obviously, they can ignore it, but they have to make out as if they have... Every crime, has a crime code, and there a book full of the code's and punishment for each crime.. They have to stick within some set guidelines of punishment for each crime.. So with letters and such, they are more likely to go to the lower end of the scale, rather than the higher..

Depends how soon she drove after the drink, how big of a glass it was, I'v had a glass of wine before that was a fiver, and it had half a bottle in a big wine glass.. How much she had eaten that day, how long ago she had eaten, if there was drink in the system from last night.. Alot of factors.
I have been to court, so i know how it all works, and i know 1st hand, giving your plea, and making out you feel really bad, and remorseful, makes alot of difference, like i said, kept me out of prison, in the judges own words.

2) she should have slept in her car. Clearly she thought 'I'll risk it' an it bit her on the ass
3) definite ban
4) the only set sentence reduction is a third off for an early guilty plea. Yes judges are told what certain mitigating factors and aggravating factors they can take into account, and might even be given examples like 'first offence less than 1.5 times the limit no accident is 12month ban' HOWEVER only they decide what weight to give to what she says. If I were a judge and she came in telling me 'it was only a glass of wine m'lud' I'd consider her a liar and give her a longer ban.
5) I know someone in a similar situation, got an 18 month ban and £500 in fines and costs

Also tell her not to worry its only magistrates court she'll be in the court room for about 5 mins confirm its her, hear the police evidence, plead guilty, get told the length of van and fine.

10 months left, won't be driving for a couple of years after it anyway. Combination of moving to Liverpool city centre and the conviction on my licence adds 2 grand to my insurance quotes and I was only just over the limit at 42.

Don't get yourself in a situation where you have to sleep drunk in your car then. Nanny state should prevent deaths caused by drink driving as much as they possibly can. If that involves removing drunk people from inside their vehicle then I'm perfectly fine with that.
I have also been once involved in a situation where a drunktard was parked in the street against someone's front door with the music blaring out and a bottle of jack in his right hand. Me and the neighbours all came out as one to remove his keys, the bottle and prevent some potential drama. The guy got arrested and charged, as far as I am concerned that was the right thing to do. We didn't wait to see if he would fall asleep.

Not narrow minded at all really is it, if anything, its you, you don't know any of her circumstances.. Maybe she lived out in the sticks where she had no option but to drive somewhere, maybe she had just eaten, so was under the impression she would be under the limit.
But im sure you have never driven hungover..

Cheers smith and other useful posts, everyone else as i already said your opinion is fine but not really required..
I'm against drink driving, not done it myself knowingly but after heavy sessions the following day i've drove n not thought about it... Different circumstances however..
In regards to askin the neighbours she lives with her nan, all the neighbours are of similar age and literally in bed at sunset! She'd give someone a heart attack banging on there door late at night (for old people its late anyway)
She will get the punishment in which the law states she deserves.. Thanks for the useful input!
I also dare bet 75% of people slagging her off have drove when they probably shouldnt have!
If i was her in her position i'd of done the same! Sitting in her car all night in an area that is known to be a bit rough or walk about half hour with no phone in case of emergency!
If i was a young female id definately get myself somewhere safe for the night, if i felt perfectly fine ( which she says she did)
She only got pulled due to a cracked back light which was blinding an officer, he then realised she was being extremely sheepish!
She may have drank more but it was over a prolonged period and she had eaten... But trust me it wasnt a great deal, i know her n she's practically stone cold sober after a bottle!

55 is fairly over the limit and that's after the drive to the police station so could have even been double before her decision to drive. Alcohol affects people differently, some people can drink more than others before they are over the limit. I reckon a bottle of beer could put some people over the limit!
Personally I simply do not drink if I know I will be driving, what's the point if the risk element is still there for the sake of one drink?

i dont agree with the if you have your keys on you law that its an intent to drive because my mate got done as he got drunk and realised he was too drunk to ride his bike home so he simply pushed it up the hill on the path home only to be stopped and to be charged with drink riding. now i think thats harsh as he was trying to do the right thing.

9/10 people will have drink driven without even realising they have done. After a decent night on the lash most people will still be well over after 24 hours.
A lot of people think food/water sobers you up faster. It doesn't, it actually slows down the rate which your body processes the alcohol.
Ignorance isn't an excuse, people should be educated on it when taking their test.
I suppose everyone on here bought a Saxo for their practicality and build quality too...

People who drive after a night out don't particularly have the same "mens rea" for the act, as Cal said, unwittingly they drive without realising that they technically are still over the limit.
MR in both cases is recklessness, and both as bad as each other IMO

I'm not on a bandwagon, I just hate how everyone on here, jumps on having a go at someone when they make a mistake.. End of the day, its a mistake, People have bigger tolerances to others, i can drink a bottle of vodka, then go out in town on the lash all night.. Some people have 3 cans of larger, and are on their arse..
No one knows her full circumstances, and 90% of people on here will have driven the day after going out for a few ales, and not even thought about it.. Im sure 50% will have thought in the morning "nah il be fine, only a quick drive, i wont get stopped" and done it anyway, in the back of your mind knowingly doing it..
End of the day, drink drivings wrong, but Matt asked if someone could give advise for court, not tell him what he already knew about drink driving.
Oh, and its confirmed, Manu is a bell end, who is sat on a horse with stilts, who has obviously never ever broken any law, and likes to live in that little dream world where he believes that.

Although I am not in anyway condoning what she has done is in anyway correct. People can learn from their mistakes, following a punishment. So ban her for life and have a dead warthog shoved up her bum for now and eternity really isn't necessary.
And as far as the law about drink driving when sleeping in your car, the trail to prosecution has changed recently. In the past, you had to prove you weren't going to drive the car. Now, the police have to prove you were going to drive the car.

Anyway. There are two views firstly like others have said one less potentially 'dangerous' driver off the roads, secondly it was a mistake and we learn by these mistakes. I think it will be a community service sentence. I say this because where I used to work in a charity shop we were sent people by courts for roughly a few months until they had dealt their time.
Now with me being the nosey cunt that I am I asked them, and the majority easily were for drink driving. But that's my thoughts.

i didnt try blagging my way out when i lost my license!

To blow 55 she would have had about 5 units of alcohol left in her system, that's over half a bottle so allowing time to drink it, drive home, get caught and get to the station I'd bet my bank balance on her having the full bottle.

I did go on to say in a future post she had more than a glass of wine, she told me on the phone whilst her mum was with her.. and then told me what she had actually drunk afterwards as she didn't want her mum to know she had drunk more...
How is she trying to blag her way out of it? After looking at the general process of what happens it seems you should make a plea statement so that you explain the situation and then your circumstances etc can be catered for...
Not to try and blag out of it at all, she is totally prepared to lose her license, she just wants to prevent further action such as a hefty fine and community service as she already works quite a lot of hours a week!
You lost your license? How does that make you any different then, you must of been driving in a manor which endangered others?
But you took the punishment and lost your license, which she is accepting and not trying to make excuses for..
The whole part of her plea will be to accept her punishment but bear in mind she earns very little and couldn't pay any hefty fines immediately etc...
Don't get me wrong I don't condone drink driving at all, but I've made mistakes and possibly drove over the limit without knowing such as the morning after a heavy night...
I dare bet many others have also done this and convinced themselves they are ok when actually they are not... but this is a forum known for its careful drivers...

yeah, she's not doing it though.
She has cancelled her insurance and sold her car, she doesn't particularly need a car so she will just wait till her insurance isn't a rip off...
I would say that the insurance helps keep previous drink drivers off the road a bit longer due to the excessive cost which can only be a good thing!!

im on a ban atm for drink driving......yes im a twat but i dont care what people think of me, it was a human error we all make mistakes
i blew 41 at the station, if i blew 40 they was gonna let me walk free cos they give u a leeway cos the machine aint 100% right....only way to get a 100% true reading is by doing a blood test..........i did a urine test aswell cos i blew under 50 which was optional.......but i ended up with a 12month ban, reduced to 9 months cos i did the course and a £200 fine
but the course is very interesting, the stats actually say 3500-4000 ppl are killed on the road each year, but only 400-600 is down to drink driving, so thats say something in my eyes, not saying its right to drink drive, but its not right to call ppl that has made that mistake a twat tbh.
but ive paying my punishment for it now and i aint gonna do it again :y:

Wouldn't that reduce the rate of the break down of alcohol? I thought it was better to do nothing so more blood goes to liver so the enzymes do whatever they do quicker. (Basic knowledge so I could be wrong).

No one got hurt, she was just unlucky to be caught.. Blowing 55 she can't of even been that drunk at all, they should get rid of that system and just adopt the olden days way where if you can't walk in a straight line or see how many fingers he's holding up, then you're pissed and should be escorted home to your bed :y:

I've got loads of bits and bobs bought for it in my mates garage pal!!
But we are always working on his car at the moment as it is a damn site more exciting than mine aha!
Got suspension, lights, exhaust, spacers and other bits and bobs... they just need putting on! Half tempted to sell all the bits though to a mate and get rid of the car!
I can afford to get something a bit more outrageous now I am fully qualified and don't have to travel so much for work :y:
So I could sell everything up and getting something a little older but a lot faster maybe...

people who get caught doing silly things that could take lives (drink drive / phone / speeding / cutting corners / jumping lights etc etc) should be made to stand up infront of school kids and explain why they thought it was acceptable to do such a thing.
a local primary school has joined forces with its local cop shop and at lunch time they will pull over speeders outside teh school and make them go into the playground and apologise.

In regards to the speeding outside a school, it is fucked up!
People never speed outside a school when the kids are outside the school premises and there are too many cars to do so anyway, therefore when you do speed past the school all the kids should be safely inside the classrooms..
If you do run one over it's fair punishment for being a truenting little twat!!

I drunke and drove once about a month after getting my car, had a 'race' with my mate, police came off a dual-carriage way as we went onto it and they followed us, at this point I realised how stupid I was, not only for personal loss money/fines/etc and the fact I was probably 3 times over the limit. But for the things that 'could' happen, other persons deaths etc albeit it was 3am on a Sunday night so no one was about but since that I Have never/will never ever drink drive again, it's not worth it, nowadays I'll drive somewhere and if I drink I'll get a taxi/bus home and pickup my car the following afternoon, the consequences are too great.
