So last night a speed gun clocked me doing 81mph, in a 40mph zone :wall:, and they said I have to go to court for it. It was on a big road, like a single lane dual carriageway thing just after midnight, how many points/ban/fine do you think I could be looking at?

double the limit, easy ban.. Be 12 months id expect.. If you have been driving less than 2 years, you will have to resit test, probably an extended one.. £500ish in fines too

you will get 6 points for driving with undue care and attention, maybe dangerous driving.. probably about £500 after all your court costs, depending if you get a solicitor, probably pointless though.. When you resit the test, you will have all the points, and have to declare them to insurance for 5 years from the date your are in court..

If it's going to be all that anyway will it be worth paying the extra for a solicitor as i'm fucked no matter what they say?

If convicted, you will be banned a minimum of 12 months, maximum 15. You will need to perform an extended retest.

If you were proved to be "showing off" or this was in a built up area or on a busy road, the magistrates will consider a custodial sentence or severe community service, plus a potential >24 month ban.

If you had passengers in the car it's considered more dangerous, and therefore expect a higher penalty.

I got caught doing 81 on a 50 dual carriageway coming off a roundabout on a sunny Sunday with no traffic on the road. Got given 6 points and £580 fine but when my licence was sent back I didn't have the points and checked about a year ago to find out it's still clean.

There aren't even court guidelines for 80+ in a 40 zone for speeding, so it's direct to dangerous driving. I've just re-read the guidelines as my knowledge of dangerous driving isn't as current as speeding and it's not good news.

The "starting point" is a 12 week custodial sentence when the dangerous driving is as a result of excess speed you're going to have to fight to NOT get a custodial sentence. Minimum ban will be 15 months.

Get a solicitor. Tomorrow.

Where was your convicting court? Not heard of a course to negotiate the points for dangerous driving before. Interested :)

I was under the impression :

Eligibility for a Speed Awareness course is calculated by taking the speed limit plus ten per cent, then allowing an additional two to nine mph (the Association of Chief Police Officers recommends no more than an additional six mph).


And I can't find anything about dangerous driving on google.

Didnt go to court, was issued a letter from the police saying basically you supply the lube or take this course, took it and never looked back tbh... It was 8 months after passed my test, was for dangerous driving 6 points (12 montn ban and extended resit shit) or driver awareness course... Not everwhere does it, i was lucky spose... But its out there and people dont know about it!!

See if you can find more details. It's not a speed awareness course as that doesn't apply. And it's not a driver improvement course as that's only applicable for driving without due care and attention. I can't find anything for dangerous driving. Weird.

I shall endevour to find the paper i was sent... Will explain all mate! Was chatting to a bloke on it who had a fully modified evo 8 (at the time) and he had a drag race with a volvo at the lights... Turned out to be an unmarked copper... FUCKED! Was kinda funny but ill go back and have a look at it :-)

Doing 50 odd probably would have been ok.

Mate of mine got clocked doing 41 in a 30 by a camera van working in conjunction with the iPhone sporting old people of the area. Speed awareness course, its a chin up moment for him.

Where as you will need to construct some sort of "chin raising" apparatus which you'll need to wear for the next few years.

Most people I see behind saxos drive it nice and easy. The funny thing is, those who are caning it up and down the roads usually don't last very long.. It's either crash or loss of licence. Happened to one of my neighbours just a few days ago, his car went on a flat bed and never came back. Think he's gone to buy a pair of shoes.

6 for driving with undue care and attention (rolled saxo trolololol)
6 for driving with no insurance (stopped at 5 to midnight at the end of my road, insurance ran out at midnight, contested in court, they pretty much said rules are rules, when the officer checked, it wasnt insured, car impounded, and about £300 in fines nd court costs)

Although since last week, next time i insure i will only have to declare the last 6

OUCH! Yeah I remember reading I believe to be that thread on it with the 5 to midnight insurance. That sucked, so far so good no discrepancies but you just never know.

Noop, got my 1st 5, they were fine, the next 6, that made it over 6 points in 1st 2 years.. Sat my theory 5 days after court, resat my test the wednesday after that, passed, was off the road a total of 9 days..

Then my last 6, were put on after the 1st 11 were taken off the database.. (3 years) but remain on your paper copy for so many years..

But as long as they don't stack up in 3 years, your fine :)

court hearing was 27th july (guilty by post) they sent the outcome letter on 2nd aug, didnt recieve it until 4th aug but expect me to pay 275 by the 9th aug......dont f***ing think so somehow lol

Back on topic, I am guilty of speeding, but never to the extreme of getting caught for it. I'm not sure what will happen to you.

The banter is always good on here mate, just got very boring lol.

I only tend to come on to annoy people, buy things or sell things!

I interpreted that to mean you take drugs most nights, and get up for work most mornings. Apologies.

I know you were reffering to that post, well they say while you are awake it takes 6 hours for the effects of cannabis to fully wear off - so if i have 8-9 hours sleep surely im completely sober upon waking up - well i know for a fact i am!
Also i do not start that early anymore - i have another job now.

See if you can find more details. It's not a speed awareness course as that doesn't apply. And it's not a driver improvement course as that's only applicable for driving without due care and attention. I can't find anything for dangerous driving. Weird.

In answer... They wanted todo me for dangerous driving i contested and basically said prove it or it wont stand up in court, so they "lowered it" to driving without due care and attention...

Course or points... Course!!

Yeah theres been alot around the Marchwood/Totton area at night recently. It was on the Marchwood bypass towards between Hythe and Totton, if you know the road you'll know that it is a stupid place to have a 40mph speed limit :/

Im assuming in your case you got caught by a speed trap so looks like they will throw the book at you. Get a really really good lawyer mate and you might get off with 3 poibts and a nice big fine
