View Full Version : Parking ticket!

Skitts123

Popped into asda earlier to grab a few things, the car park was dead so loads of spaces. I decided to park in the middle of two as people tend to bang my doors and my paintwork on my gti is fairly mint.

i was in asda for 5/10 mins and came out to be met by a ticket on my window! Read the ticket and it says i have to pay a £70 fine because i parked over two spaces.

Is there anyway i can get out of this or am i going to have to pay the fine?

Can they prove it?

I've heard that private parking firms can't demand money off you so I would ignore it, my brother and a friend have had similar in McDonalds but for staying too long and just sent them a letter telling them to as good as f**k off.

Depends what the signs in the car park say about parking over 2 spaces (ie not within the lines)

But more than likely yes you will

Ignore it.

If they pursue it go find a notice within readable distance from where you parked stating that you can't park as you did, if there aren't any there then you're quids in.

Ive did that a few times and never had a ticket. Loads of people never use a space to themselfs.

It doesn't say anything about parking over the lines. It's just a max stay of 2hours

It is illegal to take two bays though.. Council would take you to court, doesn't stop me doing it ;)

normally you can ignore them if they're from a private firm, but I hope they take you to court and win if you do choose to ignore it... I reckon parking over two bays prevents people from dinging your bodywork, but makes it more likely for someone to key your car for being a thoughtless tosser.

you can go two ways with this

1* if it's a private carpark you don't have to pay anyway in certain scenarious
2* if the signs don't mention anything about parking over two lines.

Hope you have to pay every penny tbh. I love keeping my cars mint so park as far from the store as I can and then on an end space at the very edge of the space. Never get knocked. You park like that enough and your car will get keyed, and I wouldn't stop anyone doing it, but I would if someone was bashing their door against your car.

Cameras used for parking enforcement need to be approved devices

The Civil Enforcement of Parking Contraventions (Approved Devices) (England) Order 2007 (Click here for Wales). Paragraph 2c of the schedule to the above order requires that the recording device include a recording system in which "each frame of all captured images is timed (in hours, minutes and seconds), dated and sequentially numbered automatically by means of a visual counter". that's got fuck all to do with anything, the writing can be 2" tall if they like, I'm all up inside Watchdog like a motherfucker

The Private Parking Company (PPC) must make the terms clear to the user of the car park. Therefore they are obliged to place ample and appropriate signage about the car park to make those persons using the facilities aware of the terms. The signs must be clear and unambiguous and it cannot be obscured, faded, covered up or in any way difficult or impossible to read and understand. Often times those terms will include a provision that if you over stay you will be penalised to the tune of £50, £70 or whatever. They may also include a clause on clamping (I will not be dealing with the issue of clamping in this article). These signs are usually displayed at the pay stations (for pay and display) and for other car parks at the entrance and at intervals about the land. If the car park is improperly signed then immediately the PPC will be in difficulty. Thus when the driver parks the vehicle in the car park and pays or otherwise he accepts by way of his actions and a contract is formed between he and the owner of the land.

A BPA-approved operator since 1994, Excel operate a car park at the popular Peel retail centre in Stockport. It was here that motorist Martin Cutts parked in March 2010. Martin told us that he thought it would be free to park there, since he believed most big shopping centres didn't charge for their parking. He was quite surprised to get back to his car and find a £100 parking ticket on the windscreen.

The average drive may have just paid up, but Martin was no average driver. As managing director of the Plain Language Commission, his job is to campaign for clear wording and simple language, and he's a bit of an expert when it comes to signs. The BPA Code of Practice states that car park signs must be clear and visible - so that drivers have a chance to understand the terms and charges that apply.

Martin investigated, and found the sign at the entrance to the car park. While it does state that the car park is pay and display, the lettering is just 13mm high and sandwiched amongst many other lines of text. He felt that when driving past at 10mph, you couldn't be expected to read it. When he appealed Excel rejected it, and when he refused to pay again, they took him to court - and lost.

The judge visited the car park herself and agreed that there weren't clear signs to warn drivers that they needed to pay & display, dismissing Excel's claim and ordering the company to pay Martin's expenses

I usually do that since one of my doors already has a ding from someone in a car park, depends on the car park though. If it's busy obviously I won't.

To be fair if the car park was empty was it necessary to take 2 bays? still a bit harsh issuing a ticket if it was practically empty.

If you don't pay it you will probably be harassed with letters, not sure if they can affect your credit rating but worth looking in to.

I read on a money saving forum that only the council can give you a parking ticket which is legally enforcable?

If true i guess you can ignore it but you risk a clamp if you use a TCP car park in future.

Would you want to worry about getting clamped in every car park you go to because you are unsure who 'patrols' it?

I would pay it and be more careful in future, parking over two bays is taking the piss to be honest. Especially is a supermarket as they tend to be busy.

Would the police do anything or simply say its a civil matter and he will have to claim the costs back through the court?

mechsman

I was going to point the op in the direction of the CAG forums if someone hadn't already.

devilsadvocate: Clamping is soon to be illegal in England (might already be actually). If they clamp him he will need to call the police and tell them that the car is being falsely imprisioned.

I have literally 20 or 30 parking tickets from a company that patrols the carpark where I park on a daily basis. I've paid precisely nothing on any of them, and they haven't even bothered sending any paperwork after the initial ticket on the windscreen.

Different company that did bother after I wrote back (i wrote before finding CAG) effectively got told to do one after the 5th letter. Never had any comeback from that either.

Basically, unless the ticket says the EXACT words: PENALTY CHARGE NOTICE across the top, and is issued by the council, you are pretty safe ignoring it. Only possible exceptions are potentially in a hospital or railway station car park as these potentially come under different legislation.

No, it's not from the council. Ignore it, you seem to be good enough at ignoring all the advice you're getting so you shouldn't have any trouble!

There's people telling me different things and i don't want to have a pick up a hefty fine that's all.

I was telling you different things, but seriously, you're alright to ignore it.

Do your own research. Did you read any of the Consumer Action Group links? (I guess not?)

If it aint police of council don't pay it, as long as it says Charge not fine, no need to pay.

Speaking from experience I got 2 PCNs last year, one in ASDA Newquay now I think about it and one near me, both sent a crap load of threatening letters about don't ignore us, don't listen to sites advising you to ignore us, blah blah.. I went on a site, forget the name it's a big one and they all advised to ignore it, so I ignored both (this was last August and July respectively), haven't heard from them for months... March I think... Last one threatened court and bailiffs and I had 7 days to reply, then nothing lol.
