I don't get Instragram, why not just upload them to Facebook to start with? :S Or am I missing the point somewhere? Also, what is it with people with iPhones, 'oh look at me I have an instragram account and an iPhone, I can add an effect to my pictures and now im a phtographer' fuck off.

You have no idea how retarded people seem when they come up to me when im shooting events, cameras in hand - im a professional photographer too (then shows me their wankstagram portfolio)

It's more like twitter than FB, although you don't have to upload to FB or twitter... it's an option. Either way, you'd be subjected to seeing the same shit photo's albeit without a random 'filter' on it.

I like instagram, I can keep up with what my friends all over the world are up to in picture form via the photstream. If you don't like it, nobodys forced you to use it, so why get worked up about it?

Back to the original post: pretty shit I guess that they could sell my photos, I guess I'd be kind of annoyed, but I've never taken a 'good' photo with it, so I doubt they'll want any of my crap.

Some people deffo get too into it, trying to take amazing photo's with it, so i guess they're more bummed than people like me who just use it to document random stuff I see / do.

to be fair, if you post on a social network, its almost a no brainer this is going to happen sooner or later.
its a public site, open to all.
Consider Twitter, when Ched Evans raped or didnt rape that girl. 9 people named her in tweets and had to pay £600 each to the victim. Its against the law for the press to name a rape victim, these laws are passed down onto twitter, facebook, instagram and any other publicly broadcast website. I would imagine this site itslef is included in these laws. Everyone has the ability to read up and know the rules, terms and conditions but few do.
If you decide your going to publicly display a picture with the knowledge that it could potentially be seen by millions+, why shouldnt the picture be used by someone.
Plenty of people on here have saved images of saxos from build threads etc and saved them to their PC. . . thats exactly the same concept.

Because why should someone else profit from my work?

Think of it as a piece of software rather than a photo. I create it, and distribute it for free on the internet. People like it. Someone else comes along, and then sets up a website and charged for what I made, and keeps all the profit not only without giving me a kickback, but without even bothering to ASK me for permission.

In your world that's fine too?

I don't mind someone saving a copy of a photo I upload for personal use. What I would object to (and have had removed from companies in the past) is their presumption, like yours, that because it's publicly available they can do with it what they want, including using it in promotional material. They cant.

i agree with you by the way, it would frustrate me.
Though, in the case you described, no patent/ownership/copyright is designated to that piece of software. When you broadcast on instagram, its for the use of others, much like on this forum, advice written on a JP4 conversion would be used by others.
If someone was writing a manual on the conversion, they could take your snippit of info and after adding it to their text publish it. You wouldn't be able to do much.

to get round the problem with instagram i guess everyone will have to create a little signature or similar for the pictures to 'mark' them.

the software in my example would be covered under creative commons (http://creativecommons.org/). :p

Regarding the forum posts, actually (I've not checked Saxp specifically) but generally ownership goes to the site owner once posted - most forums work this way. If someone copied a body of work somone else posted on the forum and sold it in a book, the forum owner could seek redress from the author of the book.

Copyright laws are one ares where the author is actually really well covered - in everything from the written word to photographs.

(take what I'm saying with a little pinch of salt as I've not been through the process more than a few times, mostly just a few takedown notices - Ryan is probably better placed to explain in more detail as although I used to be a professional photog, he obviously still is). :)

Lol at Instagram back tracking and trying to make out their T&Cs were misinterpreted.

Bullshit. They are just concerned that they will lose the bulk of their "members" and potential investors will fail to materialise so are now going to re-write them to cover their tracks.

The problem with T&Cs nowadays though is that a lot are open to interpretation, meaning that even if someone went against what you thought and published a photo you would have to enter into a lengthy legal battle against their lawyers. Can I be arsed with that?

If they even hint at being able to use any of my media for their own gain I will remove my account. Simple.

they wont be doing anything illegally that im certain. Especially with this Leveson inquiry thats been going since that voice mail hack! i doubt they would dare!

The Leveson report would have far less input into their decision making, Instagram is an American company, thus predominantly governed by American legislation, not UK laws. Obviously though, a grey area occurs because of it's large international presence as a company, but I don't really know much about technology law.

What I do know is that America's laws are far far more relaxed in terms of what the press and media can / can't get away with - although that, and the Leveson enquiry has little to do with Instagram.
