as above.. i thought santander had screwed my credit rating (that's a story for another day)

but after viewing my credit report today..turns out it was 02! and im pretty sure theyve done it illegally

cutting it as short as poss... about 3/4 years ago i ended my contract with them..they never sent me a final bill and i forgot about it

14 months later they sent me a letter saying i owed them £67 and i paid it straight away

then they sent me a letter saying they were issuing me with a default.. which at the time i couldnt really give two fucks about tbh :zainy:

but that was that!

now... as i understand it..when issuing a default notice they have to send you a letter telling you this..and if you havent settled the bill in 28 days they can administer it yeah?

so by sending me the letter after the payment when they eventually sent me a bill..theyve not followed procedure>?

and royally screwed me over?

I have exactly the same with Vodafone. Ended contract, months later got a bill, paid instantly and the same outcome.

Annoyed me as this is the only thing against my credit rating!

same with mine.. i was blaming santander as was miss sold my settee by dfs on by now pay nothing for a year (DFS' fault)

and i ended up missing the first two payments

but its not even them.. its fucking 02!

ive already spent half an hour online to "niju" from 02's online helper.. whos given me some info about my account and told me to get intouch with the credit referalls department

but i cant see it getting me anywhere..i bet they wont remove the defaults

I got royally screwed by CPP card protection

I cancelled there service in january 2010 & they went and booked a £90 fee for ongoing protection in march 2010,

to a credit card i had closed with mbna 6 years earlier in 2005

You do not get a bill from a card you have closed , however it does default against you for not paying it.

So you you are royally fucked & its a nightmare to sort out

But CPP have been royally fucked for doing this to people and have received the largest fine in history from the ombudsman.

and they now have to give everyone there cash back who they have robbed.

its a piss take the way big companies go on.. as its the genuine ppl that suffer.. all the little smack heads couldnt care a less what rating they have.. its not like theyll evey make enough to be considered for anything worth while anyway

If it makes you feel any better , i once got defaulted by a phone company for 1p

Still a default on the final bill due to there error

So got persued for 1p

my credit report sais that bill was £67..but im n 99.99R % certain it was only £7.68

im SURE it was.. as i can remember thinking it was really funny when i got the bill

I work for a bank mate and deal with cock ups like this from 02 everyday. Threaten them with the fact that you will go to the media if it isn't corrected on your credit profile (they can do this themselves but will claim they can't as costs them money). Also tell them you will be going to the ombudsman to report them for not following procedure and having no "duty of care" to their customers. May not be a quick process but they should brick it and do as you ask. If all fails, actually go to the ombudsman and raise a complaint, they will then send that to 02 who then have 8 weeks (maybe more) to reply with an outcome, if you don't receive one or your issue isn't resolved then 02 will basically get their arses handed to them. Companies like that don't want any more bad press or problems from the ombudsman.

if i cant get any joy out of them directly ill ring "mr justice" from one of the papers... he takes the matter on himself and is pretty much guarateed to get results you want.. plus in a lot of cases compensation for the troubles

my mother had probs with orange a while back and she got allsorts..along with a phone call from the CEO of orange apologising and offering her his direct number to call with any future issues :homme:

but im just looking for info on the legalities of whats been done atm..as ive got a better chance of sorting it myself if i know the crack

andy remember that lad wgo got his phone nicked in spain on here but couldnt report it then got massive bill? he has 02 ceos contact details maybe get in touch with him??

I'm a mod on CAG (consumer action group) in the debt forum area. I've been through a lot myself, and have seen a lot more on the forums!

I did try to sort it out a while back along with the 2 late payment marks I got from Santander but was told I'd need someone who's a specialist in contract law and pay off my own back -___-

MSE forums are also quite good for info and template letters you can send out etc, but there is loads of bell ends on there now who just try and lecture you and try and tell you how to spend your money etc! witch is fine when your asking for that kind of info etc!
