My garage is adamant that aftermarket HID kits are a fail due to not having headlight washers and self levelling.
They said unless I get an email from VOSA stating that HID's dont need self levelling or washers they will continue to fail them.
This is a reply to an email from VOSA :D
Dear Mr XXXXXXXX,
Thank you for your email enquiry dated 18th April, 2013 concerning
Headlamp Levelling and cleaning devices.
The fitment of aftermarket HID headlamps is not an MOT failure. Any
headlamp washing levelling system fitted will fail if it is defective, but
not if there is no system present.
The Department for Transport DFT produce the fact sheet for the fitting
of HID lamps this is not an MOT requirement but a Legal Requirement.
I recommend contacting the Department for Transport on 0300 330 3000 for
further advice.
I hope this information has assisted you with your enquiry, but if you have

This is that such retrofit lights are not actually road legal. So the first question is are MOT testes allowed to refuse to test a none road legal vehicle? In a round about way they are. But more so most retrofit HIDs actually fail a MOT anyhow. Most are the wrong colour, many have incorrect beams pattern, many go dark when jumping from high and low beam and such like. So they would fail a MOT on there own merit.

would you be able to retro fit them from a newer version of the same car? i.e lights/levelling system/cleaner thingy from a 2012 mini fitted to a 2002 mini?

Most of them would fail on beam pattern anyway so washers and levellers will be irrelevant

Basically your MOT garage is correct.
Aftermarket HIDs are not illegal or an MOT failure because they are aftermarket.
But, almost all aftermarket HID kits will fail an MOT test because they do not pass the tests.
Basically and MOT tester cant go, 'because they are aftermarket, they are an MOT fail' they can say "your aftermarket HIDs fail because of beam pattern or whatever" almost all aftermarkets will fail.
