just wondering if anyone can shine any light on this for me.

I am picking my vtr up tomorrow from chester. I live in Gateshead however the car failed its M.O.T tuesday gone. Most of the work has been carried out but i need to drive it back home tomorrow to weld the rear arch up before i retest it. i cant get it back in to be retested up in Gateshead untill Monday afternoon.

Does anyone know the crack with driving it back home?? the retest is pre booked for 3pm monday.

Really appreciate anyones help with this :) :)

Yes, Perfectly legal... Just go for it. You dont need insurance either...

I joke.

You need an MOT to drive it home. Else you'll need to trailer it.

jamiec2149
14th June 2013, 12:09
Its fully insured like and taxed. I just cant be arsed with P.C plod and his awfull crack if hes in a stinker of a mood worse case i get pulled

jasonmayall

Then dont drive it home.

Doesnt matter if he's in a bad mood or not, you're not allowed to be driving it on the road.

you could always rent a trailer for £40 a day or so.

Or buy a VTR which has MOT already???

But i wouldn't risk it but isn't it only £60 fine for no MOT?

Gabbastard
14th June 2013, 12:15
If it doesnt have an mot then the only way to drive it is to get it to a pre-booked mot. But, theres no distance limit on where that mot station is. I checked this both with dvla and local traffic cops; both confirmed that you could book it in the other side of the country provided youre not taking the piss and the cars very doubtful in terms of roadworthiness.

m4tt274
14th June 2013, 12:20
yeah your allowed to drive to and from and place of MOT i believe.
But not at like midnight, that will be hard to prove.

Thats a good point raised however. Just buy a VTR thats good to go, MOT'd, near mint examples fetch like £500 these days.

jamiec2149
14th June 2013, 12:21
Ive spoke to a local bobby like and he said there is no distance limit and to book it in. Everything it failed on on tuesday has been done apart from the inner arch as the garage in question were quoting silly money to do it and I am a welder by trade so i could do it in a couple of hours on saturday afternoon. its prebooked into a garage near me monday.

The one ive bought is pretty much mint apart from the inner arch only had 1 owner from new and a file full of history which is pretty good going considering its a 2000 plate, every reciept for everything and is completely standard not been touched which is what i wanted so i could put my stamp onto it :)

Maximum up to £1000 I believe, but yeah it's usually just a small fine for no MOT.

I'd risk driving it back if it's only no MOT, and if you do get stopped just be polite and explain it's prebooked in and you must have misunderstood the rules and apologise.

If youre driving it 2 days beforee the test is booked in, youre taking the piss and will get done.

jamiec2149

Ive just found this on the dvla site

Refusal of an MOT Test Certificate

Form VT30 – Refusal of an MOT Test Certificate. A red form with minor details of your car, the name of tester and address of test station. This form lists the items your car failed to pass.

A Refusal of an MOT Test Certificate means one or more items have failed to meet the minimum legal requirements for a pass. The item(s) will be listed on the form. *If you intend to use your car on the roads, the item(s) will need to be replaced/repaired urgently*. It may be possible to arrange replacement/repair of failed item(s) at the test station premises, to enable your car to achieve an MOT test pass Certificate before you drive the car away.

However, if you intend to drive your car away from the test station with a Refusal of an MOT Test Certificate, there are some stipulations. It is illegal to drive a car of MOT-testable age *that does not have a current MOT test certificate* on public roads, with the exception of driving it away to a place of repair, which may include your home residence. From there you may be permitted to drive to a pre-booked place of repair, and to a pre-booked MOT test station.

It is not illegal to sell a car with a Refusal of an MOT Test Certificate, however, a buyer may be breaking the law by driving it away, unless the stipulations above are satisfied. Even then it is not guaranteed that you will not be prosecuted for driving an unroadworthy car, and your insurance may be invalidated.

You'll be fine. In case you get pulled all you have to do is make them contact the booked place and confirm yoou have an appointment with them.

Not if it's 2 days away.

However OP, if you have any friends in the motor trade who'd be willing to say, book a slot for your car to have repairs done (obviously not actually have it done, but someone to say that you've got it booked in) then you'll be fine.

nothing that prevents you to drive the car on location and leave it there for 2 days. Meanwhile, as above:

Suppose so. Yeah, hence why I said for him to get it booked in for repair. I take the above to mean that someone is coming to repair it at your house, but I dunno if they'd buy him saying he was going to repair it himself, even though he is, so I'd get it booked in with someone friendly just to be safe.

Hell no I wouldn't, I'd just risk it anyway. Chances are he wont get caught... People drive around with much worse than no MOT and don't get caught!

You're actually entirely wrong... No MOT can void your insurance in event of a crash, but you wont be done for driving without insurance. Also, it's definitely a fine up to a maximum of £1,000 with no points or anything.

https://www.gov.uk/highway-code-penalties/penalty-table

As you can see, no MOT = £1,000 penalty.

Think it depends on something... I'm sure Ross explained it before, but it's a max fine of £1,000 I think, normally only something daft like £60, but obviously if you're caught more than once, they'll throw the book at you I'd imagine.

Nope. You can insure a car without MOT, but if you're in a crash, they'll pay out then recover the costs off you through the court. Or that is how it used to work anyway, wasn't aware it had changed. Perhaps one of the police folk on here can shed some light, Saxoladlesta or Willsy?
