Ok so I work at a go-karting track and have done for 3 1/2 years now. Basically they should provide me with steel toe cap boots by law and I grew out of the ones that I bought about christmas time and I asked work to buy me some more.
They have been saying since christmas that they will buy me some and I'm still waiting for them and in the past 5 months I have to wear my own trainers/shoes and I have ruined 3 pairs of shoes which comes to about £200 and each time I've mentioned I'd like money back for the shoes they basically stick 2 fingers up. I have been pestering and pestering for the boots and still got nothing.
Anyway we have a noise meter that goes down the far end of the track to monitor the noise of the go-karts and us marshalls have to take it down the far end of the track every morning and we always take it in a go-kart, sat on our lap. On Friday when I was taking it down it fell out the kart and got stuck under the chassis and scraped along a bit, I stopped as quickly as possible and got it out. It was scraped and battered but it was still working.
Finished work all fine, had Saturday off and then went into work Sunday and was told I would have to pay £50 for a new noise meter because I had broken it because it's not fair that it has to come out of the businesses pocket.
Firstly, no proof I had broken it because it was working when I left it. Secondly, its not fair that £200 for shoes which are all now ruined has to come out of my pocket but they just said its not their problem even though it is...and thirdly, I haven't ever been told or signed anything to say if I was to break anything, I'd have to pay for it. It was just an accident, and I don't see how I should have to pay?! If a customer crashes and breaks a go-kart they dont have to pay anything...if I worked for Tesco and accidentally broke a trolley, I wouldn't have to pay for a new trolley...
So I've told them I'm not working for them again until I have received my £50 back and the £200 for the shoes I've ruined AND got a new pair of steel toe cap boots. I sent the text to my manager 3 days ago and she hasn't replied where she normally replies within an hour or so!
Can I take them to a tribunal or court or whats my options?

I'm not being funny but the job sounds utterly shit and it doesn't sound for one minute like it's worth your while fighting over it, you'd be better just putting your time and effort into getting a better job.
Are they in the wrong, probably, they should have provided you with boots. Do they have to replace your shoes, probably not. Can they whinge at you damaging the noise meter, probably. It's 50/50 at best.
Chalk it up to experience and don't waste your time on it.

Air max haha :homme: In case people are interested, it was a pair of Adidas Sambas, Adidas Original Hi Tops and some Nike Blazers :P
About £250...yeah I'd say its worth it!

Lol 19 but they were a size 9 and I'm a size 10/11 and they just started to become too uncomfortable and they were old and battered and they just weren't useable anymore :)

Dude, steel toes can be had starting from £20, fuck it, you can even get converse steel toes if your that much of a queen.

I thought this lol. I wear steel toes in the garage fucking about with my own car, they're decent enough Dickies, I think I might have paid £35 for them lol.
The irony is OP, you've gone through 3 pairs of your own costly shoes instead of just buying a pair of steelies and chasing your gaffer for the cost of them.

employers have to provide all equipment to do your job safely by law!
on that basis they do need to buy your steeltoecaps,
can they take money out of your wages, if youve not signed anything,
again against the law..
not sure on how youd stand for a refund on 3 pairs of trainers but i recon a good chance as it was done in work and them not providing the proper footwear,
is it worth the hassle? probably not ...
get a new job!

PPE is something that employers should not be skimping out on, personally i'd accidentally on purpose run a go-kart on my foot and claim it's seriously hurt you and potentially broke a bone in your foot or some toes etc...
Not to sue them or anything but just put the shitters up them and make them realise they need to provide suitable protective equipment for the employees wellbeing as it could honestly come back to bite them.
I can see why you'd be pissed off over several pairs of trainers as it's £250 of trainers that you can no longer wear and you'd need to spend the same again to buy another pair of each.. so if you aren't compensated you could be doubling your losses.
It isn't however worth a tribunal imo over such monetary loss, if there that tight, i'd imagine you could get a better paid job with better prospects quite easily. Although it may not be as fun.
The main issue i see here is with management clearly not understanding the legislation and laws they need to follow, or the consequences they face by not doing so.

They cant take money out your wages. Try talking to citizen advice. Your trainers really are your fault. If not screwfix have dewalt steel toe caps on offer at 39.99. Saves fooking up your trainers

1 - Doing things lads do allows her to interact with men, otherwise she'd
definitely struggle...

Read the 1st post, cba to read the rest.. You're entitled to boots, but then again, you can't whinge about how much your trainers are worth... No one was stopping you going out and spending £20 on some steel toecap boots, or £10 on some cheap trainers.. A pair of sambas, blazers, and hi tops are about £150-180.. Not £250.
You broke something, they are making you pay for it.. Tesco is a huge company, which will happily take a £50 accident on the chin, in all rights, you damaged/broke something, so they are entitled to ask you to pay for it.. If you worked for me, and broke one of my tools, by misusing it, i'd expect the money off you..
What can you take them to court for? Not providing you with boots? Can't take them for you refusing to work, because they didn't sack you.. Although they can now, because not turning up to work will be a sackable offence
