View Full Version : Hit by an uninsured driver

I was wondering if any of you have had any experiences like mine and what did you do about it?
Back in August an uninsured driver drove into me on a roundabout. He was really abusive and refused to give me his details, so the police were called. He was arrested for no insurance. Basically, my insurnace company have paid for the repairs, I paid an excess of £500 and my no claims have gone ...plus insurance has risen to £2000. :rage:
The thing is, everything has just ground to a hault. The uninsured guy is in Germany, my insurance company won't help me anymore and police refuse to give me any info. Solicitors can't do much without police's cooperation. :wall:
So, is there anything I can do to get my no claims back? ... Or is it all a loss?

never been involved with anything like that before or anything regarding insurance
but i doubt you will be able to get no claims back as you have claimed

aaawww man thats a piss take! uninsured drivers are the people i hate the most, i meen you have to try look on the bright side, at least he didnt knock over some little kid or killed someone in the accident. hope he gets what he deserves

yeh they make me sick. cus i have to fork out £60 in tax every year to pay for them.

The insurance company told me to claim from them as I needed the car back on the road asap then get in touch with "the motor insurers bureau" who would claim off the other driver, get my money back and my no claims.
I phoned the insurers bureau who then told me they didn't actually do that and my insurance company had got it wrong.

looks like there just trying to move the problem to someone else, fight your case, you obviously dont want to lose your NCB!!!!!! and why wont the police give out details of the other driver? surely hed have to pay the cost in a hefty fine???

I really don't know. I don't know where I stand in this matter which is why I posted the problem here.
The thing is, he was so abusive at the time. I think he thought, because there was two of them and one of me, he could intimidate me into submission. He tried to get me to sign a piece of paper saying it was my fault! That's kind of fueling my anger and making me want to fight it.

just whatever happens dont give in thinking "i cant be bothered with all this hassle, its easier just to leave it" even if it takes time do you really want to lose NCB? plus it would be your dignity if you just gave up wouldnt it!

If you're hit by an uninsured driver and you have full legal cover it would be the job of the legal team to recover any costs from the other party.
Problem is you appear to have accepted some liability by paying out your excess.
I was hit by an uninsured driver a while ago and the police were called. Car was still drivable so I drove it until my insurance sorted out the repairs. Didn't cost me a penny and I still have my no claims.
Because of the data protection act you won't get any info from the police

it's call "no claims for a reason"
you made a claim doesn't matter if your fault or not. unless uve got proteted or the other person admits it was there fault!

What insurance company are you with? Every insurance company has a claims and legal team/department. You're paying them to insure/cover you so it's their job to sort it and get your money back. It's a criminal/civil offence to drive without insurance. Did this person get banned from driving? To be honest, they don't have a leg to stand on but I do suggest you speak to your insurance company and collect all the details from them and then ask the police for information/reports and with that information you can then approach a solicitor. Obviously you'd need to pay legal fee's, etc... but if the other person is found guilty (which there is a 99% chance they will be) then you'll get all that money back.
If somebody's involved in an accident where they were not at fault, to get the ball rolling, you contact your insurance company, report it and then they have you booked in to one of their local approved repair garages. If the insurance company are having difficulties in getting hold of the third party and also getting them to admit liability, then they'd get your car in, have it repaired, get you to pay the excess and then if they do ever find the third party guilty, then you're insurance company can claim all the money/expenses back that you have lost.
However... if this third party was insured then you'd save a lot of time and money by approaching his/her insurance company direct and therefore not letting your company get involved but only to report it to them and tell them you're dealing with the third party's insurance company direct.

donna - don’t give up, you will get your money back at some point unless the guy disappears completely. he doesn’t have a leg to stand on.
I’m suppressed he didn’t drive off when he hit you as that’s what most uninsured drivers do. your lucky to have his details at all.
also if it does get sorted you may be able to get back the extra money you have had to pay on insurance since the accident.

pretty much the same thing has happened to a friend of mine, his still hasnt been sort out, and the uninsured driver has been seen drivin a different car around the same area, still the police wont do anythin, i really hope it gets sorted soon for you

Hey Donna, was having a read through the thread and I definatly agree with Damo on this.
In a way you have been cheated out of fairness due to somebody elses actions. Your the inoccent one here so you need to get in contact with the insurance company to get the details you require.
Its a difficult situation due to the fact that police were involved and your insurance company had to be notified. Would of been easier if the twat just game you the money for the damage.
Absolute dickhead! Sorry really pisses me off. Hope all goes well anyways.

I was starting to loose hope - it's all so complicated! I just wanted to see if any of you thought I still stood a chance. I'll keep trying. Thanks again. :)
