some little old lady just crashed into my car, was going to blockbusters to take back some dvds, was driving along the street and saw a space, indicated started to pull in, was 3/4 of the way in and then something hit me from behind. there was a little woman in the space in front of me she said she thought i was indicating for the junction at the end of the road so she started reversing back so she could pull out of her space. anyway i got her details and the damage ent two bad, the rear quarter vt pannel and the rear bumper need respraying

i almost crashed last night too mate, went round a corner not going fast or anything and completely lost it, it was like being on ice. thankfully i managed to gain control in time but it was quite scary.

my mate did that in his car but hit a van on the otherside of the bend - hit rear quarter

yeah it could have been alot worse, she got out and said "so whos fault was it then?" i said " well i indicated for the space, your car was stationary and i was well over half way in beofore you reversed back and 3/4 in when u hit me" then she said ok and proceeded to tell me she thought i was indicating for the junction at the end of the road lol just a bit of a pain having to go get it sorted even tho shes paying

Sounds like an honest mistake but common sense should have prevailed on her part. Even if she was insured its still a pain in the arse when somebody hits ya, so much to sort out. I agree that anybody over 55 should retake the test that we have to go through. Tests were so much easier 30 years ago and i dont think half the older people would pass a modern driving test.
My grandads a good example, he brakes so hard ppl nearly go through the windscreen, he overrevs EVERY gear and he has lost 6, count em 6 wing mirrors in 18 months becuase he drives to close to other cars.

well in that case anybody whom has a crash and its there fault should sit the test again.
imo old people are a lot safer than 90% of young drivers, i no the roads change but they have x amount of yers experience, what experience does a 17 yr old have, apart from lessons

x amount of years driving in the 1970's ?
Think how busy it is now compared to when they passed their tests, and how different things are. I think everyone should resit their tests at some point, just to get all the complacency sorted out, not just oldies.

oh dear thats not good mate. People should be made to retake their driving test every 10/15 years :P as it's not just old people who can't drive lol.

Yet again its not just old people,I think everybody should take their tests again every ten years

i just called her to let her know that i been to 2 different bodyshops and there sending written quotes out in the morning. then she said "i have been thinking and its your word against mine so i dont think its right that i should have another claim on my insurance (another claim how many u had) anyway she grumbled on and said i have two options 1) pay 4 it myself or 2) let the court decide
i am really fucked off now i mean its not that bad but needs the rear vt quarter pannel and rear bumper resprayed so do i go to court and have to wail ages for it to get sorted or do i jsut pay for it myself? if it was dented i would without a doubt go to court but its just paint so duno what to do as who will the courts beleive a 70 coffin dodger or a 23year old with a modified car

There is no way she thought of that herself, someone else told her to say that. If you have her address go round and pay her a visit, maybe speak to her son/daughter/husband whatever see what they have to say. Also go back to where it happened, look for CCTV cameras on shops and stuff.
Going to court may be a long drawn out process and in order to prove what happened the court may ask a garage to have a look at your car to see if they can work it out.

I personally woulnt go round. Could be seen as harassment then you would get into a spot of bother.
Ring the police and notifiy them of the accident, explain situation. Then contact her insurance company (if you have the details), failing that contact yours and explain IT IS HER FAULT but there might be a problem, I know some of these bastards look at your policy see your age and just go and pay out regardless.

i jsut called blockbusters and there cctv only covers the front door of the place and inside and thats the only place with cctv there, there were no witnesses and she said her son is a police officer which i dont know to beleive or not, shes definatly talked to someone as earlier when it happened she willingly gave me her details and said to contact her before i put it through the insurance coz she might jsut pay instead.
i jsut well fucked off now as do i drive a car that looks shit and have to wait ages to get it fixed coz of the courts (which if shes tellign the truth bout her son beeing a copper will prob ruin my chances of winning anyway and then i will still ahve to pay for it ) or do i jsut sort it myself even tho i should have to?

if you choose to start repairing it, keep the receipts and all that. I know its common sense that but hey ho.
bollocks the police officer stuff. Has nothing to do with him, this is an insurance thing and court thingy.
Fight it, but I'd start writing down what happened as accurately as you can remember, its easy for the story to change as you forget little things and that.
write down every exact detail even if it seem contrived initially.

contact her and tell her it will be going through insurance if she wont be reasonable. The insurance companies will find out who's fault it is on inspection.

i jsut emailed someone wos got a silver vt rear bumper and d/s quarter pannel if its a chepa price i will jsut buy it then go round to hers and see if she will give me something towards it then get her to sign a bit of paper saying that we sorted it out so she dont go to courts later sayign i hit and run or some shite, if its not chepa then i will take it to the courts but its jsut the time these things take that fucks me off

Tricky Situation. You might be right in thinking it would be easier to pay for it yourself. I would personally go round her house but thats just me, i mean what have you got to lose if she will not accept it was her fault. Its not harrassment if you are just going round there to talk to her. If you threaten or go round there loads of times then it can be harrassment.
As there is no evidence/witnesses to prove either party was to blame, if you go to court they will probably rule it an accedent on both parts and advise to to claim off your own insurance compaines.
There is no point going to the police becuase it is a civil matter and they wont wanna go anywhere near it becuase they are there for criminal matters. Also if her son is a police officer and he has advised her to say what she did then he has broken the law (Not that the old bill care if one of thier own has done something wrong)
Bottom line, you are most probably gonna end up paying for it yourself or gonna spend heap loads of money on legal advice taking it too court.

yeah thats what i am thinking mate so thats why i think it might be easyer to sort it myself even tho i am in the right, if my car was proper fucked or dented i would be happy to go to the courts but for arund £150-£180 max respray damage is it realy worth the hasstle, time and legal costs and then to listen to them say its a 50:50 claim and then have a claim on my insurance

Mate thats bent, so many blind twats out on the roads. Basically imo, if you take it to the courts/insurance claim with dispute its gonna take fuckin ages and really piss you off. It aint fair but if shes gonna act like this its probably best to just walk away as you dont have any solid evidence and like you said the courts, insurance companies etc are ever so slioghtly biased against saxo drivers as i found out. I hope it all gets sorted out quickly and you can just forget about it then.

its a 50 / 50 fault accident.. you didn't see her reversing.. she didn't see you and you reversed into each other ... either tell your insurance company about it or pay for the damage yourself. You won't win if you file in the small claims court..

which law has been broken?
It is oen persons word against another in what is obviously a 50 / 50 fault accident.
If you don't report it to your insurance company then you do only have those 2 options stated.
All her son has given her is the correct advice.. sucks but thats life.

ok i have spoken to her now and decided to accept it that we dont put it through the insurance and both sort our own cars out :( bit of a bummer but it could ave been worse and wont be 2 hard to sort i dont think
