View Full Version : Car scratched in bump - claim or not?

I was at Asda tonight and some stupid woman reversed out a space without looking and hit my car! Got out to inspect the damage, some small scratches and some lacquer off the back arch, nothing too major thankfully! So I went and asked the woman for her insurance details but she refuses to give me them and calls her dad to come and deal with me... so I call the police as I thought they could get the details from her and provide me with them.

Police arrived and after listening to the womans story, they tell me she was in the wrong but advise me not to do anything about it as I can just slap some wax on the scratches. Yeah... Anyway, I decided that I wanted an accident report made just incase I decide to claim and this is where I'm stuck at, should I claim or not? Also, the police wouldn't give me the womans insurance details as "they are not allowed to".

I called my insurance company and they said that without the other persons details (apart from reg number) I could only claim through my insurance which has about an £800 excess which I would need to pay, although I was advised that I would eventually get this back once they track down the womans insurance company and speak to them. Not too keen to do it this way as her insurance may refuse to pay. So my insurance told me that the police lied and that they can give me either a phone number for the woman or her insurance companies name, just as long as it's nothing that would tell me where she lives.

Sorry for the big rant but I love my cars and hate them getting hurt lol. Does anyone have any advice for me?

sue the police for mal practice! It would fuck up her insurance though - so you have to ask yourself was she hot? if she was then i wouldnt do it if she isnt go for it! lol joking but if its not so much to repair maybe itd just be easier to repair it - itd be an injustice but who said the worlds fair?

should have gotten a trolly and rammed it into her car and said sorry lost control and im not insured to drive a trolly so im afraid you cant claim!!

i would proberbly fix it urself then if you can track her down get her reg then get her insurance details and charge her....

If you can fix it yourself I would, as the last thing you want is a claim on your policy and a big excess.

And, even if in the end, it comes from her insurance, it will be logged on yours as a claim! I hate this world!:rage:

Happened to me, my next door neighbour was trying to park up, and apparently 'pressed the gas instead of brake!' and went right in my bonnet.

Being dead funny about it, I had to go through mine, and when it came to renew, my premium went up! Even though in the end, her insurance paid out!

i would sort it out urself , but while i was at the car park would have asked for cash to repair

saxooxas - no she wasn't hot so I'm fine there lol.

Might not put a claim in if it will raise my premium, probably cheaper fixing it! Seems stupid that it's down as your claim when you're not in the wrong!

And as for asking for cash, I couldn't talk to the woman, she was just screaming at me. Tried to talk calmly to her but gave up after a while and sat in my car.

One thing I'm not too sure about is that some of the lacquer has been scraped off and my brother told me that eventually the rest of the lacquer will peel off because of this, is that true?
