Vehicles used in manner causing alarm, distress or annoyance

(1) Where a constable in uniform has reasonable grounds for believing that a motor vehicle is being used on any occasion in a manner which-



(a) contravenes section 3 or 34 of the Road Traffic Act 1988 (c. 52) (careless and inconsiderate driving and prohibition of off-road driving), and



(b) is causing, or is likely to cause, alarm, distress or annoyance to members of the public,

he shall have the powers set out in subsection (3).

(2) A constable in uniform shall also have the powers set out in subsection
(3) where he has reasonable grounds for believing that a motor vehicle has been used on any occasion in a manner falling within subsection (1).

(3) Those powers are-



(a) power, if the motor vehicle is moving, to order the person driving it to stop the vehicle;



(b) power to seize and remove the motor vehicle;



(c) power, for the purposes of exercising a power falling within paragraph (a) or (b), to enter any premises on which he has reasonable grounds for believing the motor vehicle to be;



(d) power to use reasonable force, if necessary, in the exercise of any power conferred by any of paragraphs to (a) to (c).

(4) A constable shall not seize a motor vehicle in the exercise of the powers conferred on him by this section unless-



(a) he has warned the person appearing to him to be the person whose use falls within subsection (1) that he will seize it, if that use continues or is repeated; and



(b) it appears to him that the use has continued or been repeated after the the warning.

(5) Subsection (4) does not require a warning to be given by a constable on any occasion on which he would otherwise have the power to seize a motor vehicle under this section if-



(a) the circumstances make it impracticable for him to give the warning;



(b) the constable has already on that occasion given a warning under that subsection in respect of any use of that motor vehicle or of another motor vehicle by that person or any other person;



(c) the constable has reasonable grounds for believing that such a warning has been given on that occasion otherwise than by him; or



(d) the constable has reasonable grounds for believing that the person whose use of that motor vehicle on that occasion would justify the seizure is a person to whom a warning under that subsection has been given (whether or not by that constable or in respect the same vehicle or the same or a similar use) on a previous occasion in the previous twelve months.

(6) A person who fails to comply with an order under subsection (3)(a) is guilty of an offence and shall be liable, on summary conviction, to a fine not exceeding level 3 on the standard scale.

(7) Subsection (3)(c) does not authorise entry into a private dwelling house.

(8) The powers conferred on a constable by this section shall be exercisable only at a time when regulations under section 60 are in force.

(9) In this section-



"driving" has the same meaning as in the Road Traffic Act 1988 (c. 52);



"motor vehicle" means any mechanically propelled vehicle, whether or not it is intended or adapted for use on roads; and



"private dwelling house" does not include any garage or other structure occupied with the dwelling house, or any land appurtenant to the dwelling house.

they said they had seen a blue saxo in my area driving around stupidly........... could not confirm that it was mine...... and it wernt me, i had only just come out.
i under took some old dick driving 20mph up the bypass near me. and they said it must of been me earlier. becouse of my dangerous driving then' I.E undertaking the old guy... there fuckin dicks....

They are not allowd to take your car if they dont have relevent/sufficient evidence to prove its the one they are after

Undertaking is considered as dangerous driving, therefore they have reasonable grounds to do what they done under that section 59 thing

So you got pulled over before for your lights being too low n stuff? Did you get a S59 then? If you get an S59 and they see you doing ANYTHING wrong they are aloud to take your car and crush it. Well that's what the little piggy by the side of the road told me when I got my S59 for driving like a wanker.

So in that case if your car did get crused they could just say it was because you undertook you and looked you up to have an S59 on file already?

If you don't already have an S59 for being bad in the past I think you do have a pot to piss in as Leo said.

they only other explanation is, but this is a long shot.. you got scammed. People dress up as cops or whatever with fake ids and paperwork, and take cars. i highly doubt this though as i think they go for the expensive cars as its such a risky scam.

i got a warning in my nova then 9 months later in my almera drove about 100 meters in a car park at a cruise without my seat belt on, and they confiscatedmy car because i had already had a warning thing.i felt a bit hard done by but thinkin about it they were within there ryts.neva mind i have learnt my lesson never drive with my fogs or seatlbelt off as it can be a esxpensive mistake lol

the section 59 would be on the driver, not the car... anyone can drive anyones car in theory, so that would be unfair.

I take it the car is registered in your name?

When the police run the reg through the PNC (police national computer) it comes up with the owner, owner details, insurance etc. It also comes up with notes about your car, such as if someone else has complained about you to the police and they have it on record... It could be that you have been seen speeding or whatever, this being the result

harsh yes, but it all depends what has been said about your car.

At the end of the day, car crime is being hit on hard at the minute, mainly from dangerous driving to defective vehicles.

Either you're takin the piss or you've never been pulled before. Coppers are KNOBS to young lad drivers, any excuse to pull you over, search your car, give you a ticket etc and they'll do it, and make you suffer. I think this lads been unfairly treated and the copper is out of order with the "your lights are too low, it could cause an accident" thing, what a fucking cunty thing to say. If you we're a celeb in a naturally low sports car he'd have pulled you over and said "nice car mate, can i get a pic and an autograph for my boy.... yea, he's called PC Johnson.... I've had a fair few run-ins with the law, each time I've been correct, proved I was right and complained. Never got anything like an appology just a "ok, you don't have to pay the fine" etc. I even complained about one incident when I got pulled for drink driving, I hadn't been drinking but I had been working in a pub. Got breath tested and when it came up clean, he did it again saying "it mustn't be working, it says no trace" so I questioned him and said "if it had come up positive would I be tested again?" and he said "no, you'd be nicked" - I tried to complain on the Monday when I produced all my docs, and the young lad behind the counter "i'm sorry but they haven't booked the incident in so if you complained it would get binned because as far as we can see, they haven't pulled you over"

WHAT??????

Got breath tested and when it came up clean, he did it again saying "it mustn't be working, it says no trace" so I questioned him and said "if it had come up positive would I be tested again?" and he said "no, you'd be nicked" - I tried to complain on the Monday when I produced all my docs, and the young lad behind the counter "i'm sorry but they haven't booked the incident in so if you complained it would get binned because as far as we can see, they haven't pulled you over"

Right I disagree totally. I've been pulled for lets face it a pretty serious offence. They were totally fine with me, even joked. why? Because I was polite, obviously apologetic and did what they asked me to do and I was lippy.

Davo, how come you've been pulled so many times? Other than the one incident I have never been pulled. Feds dont look for a car with a young person in it and decide to nab them. Either there is something glaringly wrong with the car or the driver is being a dick (in both instances I'm happy for the police to do their job)

Calling them knobs is not only wrong but also suggests you arent particularly bright either or dont conduct yourself properly around the Feds

i try not to undertake, il just keep flashing my lights, if they didnt get the hint id probs undertake, altho id check my mirrors for police cars, maybe next time you should do this fella ;)

Some officers are a bit twatty unless they are family, good thing my uncle works for the met and not essex police! only officer i can stand is him, the rest just do you for whatever reason they can.

I remember a few years ago (slips into daydream) i got fined £30 and 3 points when i was 18 (long time ago now) for doing 20 in a 30. Hadnt been drinking, and my cigarettes werent made of wacky baccy! very strange. Standing at the side of the road with the two officers, when a BMW Z3 went past and they clocked him at 67mph in the 30 zone and just said "oh well, cant catch him now!". cheeky mudrollers.

Have to agree with Ad here, there are a small number that are knobs, ive been pulled a few times when i had the r, once goin round the round about, late on fast, not above the speed limit but stil fast for around about, got out n was talkin to the fella for bout 20mins or so bout my car n that, he was fine, didnt even tell me off just said take it easy, if you are good with them then it gives them no reason at all to be arsey with you

thats true matt, if you are polite 9/10 they will just let you go. I was accused of doing 120mph down the a130 near me from basildon to chelmsford.

Had my girlfriend and 3 others in the car, barely pushing 80mph, they said they chased me all the way from basildon apparently, i never saw them when i joined the a130, but hey, they'll lie through the skin of their teeth tog et you going!

120mph with 5 people in the car?? no mods to the VTR either??? I wish!

I haven't been pulled since having my VTR....

The times i used to get pulled, was when I had a STANDARD pug106. The reasons we're mainly along the lines of "its late at night, what you doing out?" or "there's 2 young lads driving a car thats easy to knick" and I have never been "lippy" to a copper. I don't speed, take drugs, drink drive, drive like a knob etc etc - I have never had any points, and the only time I've "broken the law" and paid a fine fairly was when my parking ticket ran out. I was happy to pay this fine as this was my error/mistake whatever... I was in the wrong, so I paid. No arguments.

Not bright? Far from it, I know when I'm right and I know the law. I'm not "soft/shy" so I don't sit their and let them use their little bit of power to get 1 over on me. There is a difference in being "lippy" and knowing your rights, knowing the rules and KNOWING what a copper can and can't do. If you sit their and let them tell you BULLSHIT they will continue to get away with it, and therefore are "not doing their jobs properly" - I accept that it depends on the copper and circumstances etc. and I have previously been pulled before for a routine check of my car, to which I had no complaints as the copper was polite, explained what he was doing, why he was doing it and after he didn't give me a producer or anything because there was nothing wrong with my car, and I was doing nothing wrong at the time when he pulled me. Everyone has good/bad experiences - I seem to mainly have had bad experiences.

they said they had seen a blue saxo in my area driving around stupidly........... could not confirm that it was mine...... and it wernt me, i had only just come out.
i under took some old dick driving 20mph up the bypass near me. and they said it must of been me earlier. becouse of my dangerous driving then' I.E undertaking the old guy... there fuckin dicks....

they only other explanation is, but this is a long shot.. you got scammed. People dress up as cops or whatever with fake ids and paperwork, and take cars. i highly doubt this though as i think they go for the expensive cars as its such a risky scam.


this happened around york afew months ago un-marked volvo withe all the lights and sirons

Think this has got its point across.

I dont for one second believe they seized your car on a 'hunch' that you might of been the saxo driver, I think there's a little more to the story personally. If I'm wrong then so be it.

Oh and by the way the police are NOT cunts, twats, nobs or what ever. You were in the wrong for undertaking in the first place so they had every right to pull you for the reckless driving.

Dont call them for doing there jobs.
