That doesn't implicity imply that you have no job due to the car accident. You can't be sacked, per se, for that - however, if they are making your position redundant, they are entitled to do so, irrespective of your accident. That said, they have a duty to follow set procedures and criteria relating to your position within the company.
If, for example, the company is downsizing, then there is little you can do, as long as the previously mentioned criteria are followed. Also, how long have you been at the company? If less than a year, they have grounds to dismiss you/make you redundant for any reason they see fit - longer than a year and if the company have acted "improperly" you will have cause for a claim.

Yes, they are fully entitled to do that. Just because you have a doctor's note does not give you immunity from any redundancy prodecure they have.

Ok some questions:
1) Have you worked there longer than a year?
2) Are you employed to do one particular job; i.e. do you have a specific skill set/qualification for the job?
A company is not allowed to re-advertise your specific job unless your answer to 1) is no, for a finite period. If they do, keep the advert and yes, you have a claim. :y:

Does your contract state a job title?

Does your contract state a job title?
yes,general worker
johnny_vts
9th August 2007, 10:39
yes,general worker
This potentially makes your case stronger if the position is re-advertised as you have been doing a number of different jobs. However, they would be entitled to advertise for, for example, a machine operator with a certain qualification (if you didn't possess that particular qualification).
Do other people have similar positions to yours? Were they made redundant? If not, you are entitled to ask, and be told, what procedure was followed in selection for redundancy.
One important fact to remember - you do have a duty to mitigate any losses in the face of a potential claim. What this means, is that you must actively seek, and prove you have sought, alternative employment.
Best of luck mate :y:
