How can you plead guilty to careless driving, but not death by dangerous driving? Surely if you're guilty for one, you're guilty for the other.

leeroybrown 8th December 2010 07:56

Well you would think so.

Going to be hard at Christmas this year, thats for sure!

Dom 8th December 2010 08:00

Best of luck to you guys, I couldn't imagine being in the same position.

R.I.P.

Just read through all 43 pages this morning, i was on the parade in my vts at saxp and it was good to have such a large community show their respects. Lets not talk about the idoits who embarrassed us, but still 99% of all out hearts were in the right place on the lap

I have been on this site a few years although not one of the huge posting members and i have been around while gav was regularly on here

rip

i think its great that people on here, expecially leeroy being so caring and noble on the subject

Note: someone close to my family did something similar to nathan and he killed someone. This was completely different curcumstances and nathan did worse than the guy i know, i wont go into details. However with spending a fortune on barristers and legal fees and over a year of court appearances he still got 18months and got sent down last month, so hopefully nathan will get more as he clearly deserves it!

leeroybrown 8th December 2010 11:03

Interesting read pal, thanks for the comments

Aly 8th December 2010 11:13

My family are currently in a similar position where in North Shields my two cousins (one was a front seat passenger, one was in the rear)

Two other people were in the car, driver lost control and flipped down a 50ft drop onto it's roof, only the driver survived.

Still haven't heard what is happening with the case yet :(
Happened nearly a year ago now.

leeroybrown 8th December 2010 11:14

Trail Begins in Jan.

It is now going to trial now Jan 17th.

Careless driving carries a mandatory 3 points with a maximum of 9 and a discretionary ban, while death by dangerous driving carries a 14 year prison term, so the careless driving charge is pretty meaningless in real terms. He's pleaded guilty to it because he'd lose credibility in trying to defend it as the CD charge is totally indefensible. He may also be trying to get the charge of death by dangerous driving reduced to a death by careless driving charge, which would see him go down for between 26 weeks and a maximum 2 years.

Fingers crossed for a result for Gav in January

leeroybrown 8th December 2010 11:20

Yeah CampDavid, that’s what pretty much I think Jonathan has been told (Gav's Dad)

However I have been told from one of his close friends ( we still aint sure how true this is) but when Nathan lost control of the car and crash, one of the guys who lived in the house right next to the crash came out to see what was happening.

Nathan apparently was moaning and shouting on in pain, whilst Gav was rather quiet.

However we were told that this guy managed to keep Gav alive for a total of 10 -12 min, but died before this ambulance arrived.

We still do not no how true this is, but when I visit in Feb for the anniversary of his death and 22nd birthday, I will be going town to the crash scene this time to see where it all happened and it find what it looks like to be a true hero.

Aly 8th December 2010 11:27

L720 8th December 2010 15:12

That picture is shocking.

leeroybrown 8th December 2010 15:19

Might be attending myself, depending on the date.

Lewis1600 8th December 2010 15:47

That Pic makes me sick, really does.

:(

Similar thing happend to one of my friends, he was in a car crash, in a c2 gt, 5 people in the car only the 1 one come out walking (the driver) 3 killed, and one paralized.

He was doing about 120mph and went into a tree. was on drugs + over the limit.. drinking..

Hes had 10 years prison and 12 years driving ban!!

Imo shouldnt be allowed to drive again!!

Hope Nathan gets a similar sentance!!

R.I.P Gav..

leeroybrown 23rd December 2010 14:22

Should be able to find out in Jan what he will be given.

Cammy 23rd December 2010 14:47

In all this time ive been looking at this thread scince the day it began, i never really commented - i never really knew him, and i know this thread gets brung up every week for people still to pay their respects to someone who was well known and truely appreciated.

Thats the first picture i have seen from this thread of what happened, and it really does make your spectical of what really happened prior to the devistation thats still causing allot of people pain

Its remarkable the guy managed to keep him alive for 10-12 minuets, this guy played a role in what could have saved his life, but he wouldnt needed it if the driver wasnt imcompetant - and i do hope justice is served

R.I.P Japman

jeppy24 23rd December 2010 14:49

Never forgotten mate x

Sammy-Boy 23rd December 2010 22:54

RIP mate

millerblud 26th December 2010 11:10

Never knew gav or spoke to him but from sounds of it he was a really popular guy on here :(

I know how it is to suddenly loose someone that quickly, mate of mine died in a building accident back in october :( was soo sad and roughly the same age as gav! Was keen on his car lots to! A memorial cruise was organised and nearly 200 cars attended, just shows how everyone rallys round after hearing tragic news! Like with my mate, I hope justice is followed up on this!!!

Moke 26th December 2010 13:08

Thoughts are with the family and friends.

RIP Gav x

Mochachino 26th December 2010 13:09

Happy xmas up there Gavman n happy new yearrrr! x

fossie 26th December 2010 13:59

R.I.P dude...

Tbh i hope the fucker sticks to his not guilty plea, then when the hammer falls when he is found guilty the twat will get the sentence he deserves........ the likelyhood is if he did enter a guilty plea then the sentence he would get would more than likely be fook all...........

The joker doesnt know what he is letting himself in for

leeroybrown 9th January 2011 11:56

Gavin's Court Case will be on 17th,18th,19th January at Swansea Crown Court . Nathan James Morris is charged with causing death by dangerous driving which he has pleaded Not Guilty too . The court is open to the public if anyone wants to go.

Aly 9th January 2011 12:07

Lee what is the difference in sentencing if he keeps his Plea as Not Guilty and is found guilty?

haz_pro 9th January 2011 12:45

Probably been said but how on earth would he not be found guilty. If he isn't I really am in aw at our shocking justice system(already am to be honest).
