Look at it this way. You pay for legal cover, have a crash, you're not at fault and the solicitor recovers your costs.

You don't have legal cover, you have a crash where you're not at fault, employ a solicitor, win, recover all your costs and you are no worse off. In fact you are better off because you haven't paid for legal fees at all
