Fixed Driving Penalties
Just a quicky guys! Been pulled over today and did the usual polite and understanding face. He question my camber, stretched tyres, ride height and poke.
Now, he accepted everything I said about the camber, stretched tyres and ride height but wanted to argue the poke. The DVLA states that a cars wheel can poke out 30mm from the top of the wheel to the arch AS LONG as the tread of the tyre is within the arch. All of which, mine conforms with.
He wouldn't accept this and said that he'd have to look into it more. I was allowed to leave with no penalties but i'm now wondering if I could receive anything through the post?
So long story short, does the notice have to be given at the side of the road or can fixed penalties also come through the post at a later date?

I wouldn't worry about it. He probably won't look in to it and didn't want to admit you are right and he didn't have a clue.

Doubt you'd get anything through the post. If he took pics with a tape measure etc then he could only prove that you are right so therefore still nothing through the post.

You wouldn't get a fixed penalty through the post.
If it was really going to have gone anywhere (or potentially have) then he'd have taken several good quality pictures with measurements. Even then it would be court summons rather than a fixed penalty to come through the post.
Thats general good practice. Pictures speak a thousand words is the old saying.
The poke itself wouldn't be the main issue, the stretch would. Its not too difficult to get details from the tyre manufacturer to state what size wheel a tyre should be fitted to. Outside of those recommendations there could quite easily be an argument for using a vehicle in a condition likely to cause danger to others- then it would be upto the Magistrates to decide

Cheers guys! He measured the poke but never actually took any photos. The poke is legal so i'm not particularly worried.

I think if you're going to get done you have to be given a form to sign to accept the fixed penalty notice or to take the choice to go to court.
I wouldn't worry about mate

If the copper wanted to make an issue of it he`d of either called out a traffic unit,or sent you to an mot station.

Notice of intended prosecution (NIP) doesn't have to be given at the roadside, for offences requiring a NIP this can be given within 14 days.

You'll be fine anyway Jay if he didn't take a full set of pics and write down all of the specifics on the tyre to seek manufacturer advice. That is pretty much standard practice if its likely to go anywhere.
